2aMarch 8, 2010 VIA OVERNIGHT MAIL & FAX Mr. Roger Carlton, City Manager City of South Miami 6130 Sunset Dr. South Miami, Fl. 33143 Re: Transition of PEG Channels to Digital Dear Mr. Carlton: 1681 Kennedy Causeway North Bayy VILLage, FL 33141 OA' i th va -1 3 10 / 305.861.8069 PHONEX 3/ o a 305.861.9047 FAX This letter is to give the City of South Miami formal notice that, effective August 1, 2010, Atlantic Broadband will be transitioning all public, educational and governmental ( "PEG ") channels in our Miami Beach cable system to our lowest tier of digital service. The following channels will be affected by this transition: 76 — Miami Dade Television (MDTV) 77 — Municipal Access 78 — Cable TAP Community (CTAPC) 79 — Cable TAP Learning (CTAPL) As you may be aware, this transition of PEG channels to our lowest tier of digital service is expressly allowed by Florida Statute § 610.109 (6), part of the Consumer Choice Act enacted by the Florida Legislature in 2007. The transition will not change the channel number for these channels, nor will it impact the programming placed on the channels. The transition of these channels is part of an overall transition of our cable television system to a digital format, providing better picture quality and allowing us to provide High Definition and other broadband services that our customers demand. Although these channels will be provided in a digital format, they will remain unencrypted, so that any Atlantic Broadband cable customer with a digital television set will be able to view them without change to the customer's service plan. Customers who purchase any level of digital service will also receive the channels. For the minority of customers in our Miami Beach system who do not subscribe to a digital service or who do not have a digital television set and who want to view the PEG channels, Atlantic Broadband will make a converter available for $1.00 per month that will permit access to these unencrypted digital signals. www.atLanticbb.com 2 We will begin notifying customers of this change during the month of March, 2010, and will continue to communicate with them about the change throughout the next several months. We will make every effort to ensure that there is a smooth transition. Please feel free to call me at 305 -861 -8069 ext.3101 if you would like to discuss this transition further.
