RESOLUTION NO.
A Resolution of the Mayor and City Commission of the City of South Miami,
Florida, authorizing the City Attorney to verify that Article 11, Section 6.1 of
the City's Charter conforms with the amendment adopted by voters on
November 4, 2008; and providing an effective date.
WHEREAS, the voters, on November 4, 2008 adopted the following Charter
amendment, to wit:
SHALL ARTICLE II, SECTION 6 D.I. OF THE CITY CHARTER,
"REQUIREMENTS FOR ADOPTION," BE AMENDED TO PROVIDE:
EFFECTIVE UPON PASSAGE OF . THIS AMENDMENT, ANY
ORDINANCE THAT AMENDS LAND USE AND DEVELOPMENT
REGULATIONS IN ANY MANNER TO MAKE THEM LESS
RESTRICTIVE SHALL REQUIRE FIVE AFFIRMATIVE VOTES OF
THE CITY COMMISSION?
WHEREAS, there has been confusion as to whether or not the mandate of the voters has
correctly been added to our Charter; and
WHEREAS, there is a need to clarify this matter.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA, THAT:
Section 1. The Mayor and City Commission hereby authorize the City Attorney to
review this matter and to submit a report to the City Commission as to whether or not the City's
Charter as presently written correctly and accurately conforms to the amendments as adopted by
the voters on November 4, 2008.
Section 2. This resolution will take effect immediately.
