THE CITY OF SOUTH MIAMI, FLORIDA RELATING TO THE FEE
SCHEDULE; AMENDING ORDINANCE 21 -09 -2013 TO AMEND
TEMPORARY FULL ROADWAY AND SIDEWALK CLOSURE PERMIT
FEES SCHEDULE, PROVIDING FOR SEVERABILITY, ORDINANCES
IN CONFLICT, AND AN EFFECTIVE DATE;
Request: Authorizing a revision to schedule fees.
Reason/Need: After the adoption of our current fee schedule last year, the City received several
concerns from the merchants and resident as to the increased cost of permit fees for "Temporary Full
Road and Sidewalk Closure..." such as 5 and IOK runs. As a result, the Commission requested the
Administration to review the schedule of fees and to make adjustments. In performing the review, we
have found that it is difficult to analyze an ordinance with more than 100 pages that encompass a wide
variety of fees in a brief period. Therefore a comprehensive review of special events that require road
closure is needed, including community workshops.
Recommendations:
To maintain the present "Temporary Full Road and Sidewalk Closure..." permit fee schedule, as
approved by Ordinance 21 -09 -2013, with the modification that "Permit fee not to exceed $10,000.00."
The above modification is recommended in order to address large scale road closure and events similar
to 5K Twilight Run in a brief time and to ensure that a comprehensive review of the permit fees for
events that require road closures, is done intelligently and comprehensively. The analysis will include
further comparisons from other municipalities for similar road closures and will include community
workshops and consultation with the impacted event promoters.

11 WHEREAS, On September 15, 2009 the City Commission approved ordinance
12 no. 21 -09 -2013 increasing, adding and deleting permit fees from the permit fee
13 schedule; and,

15 WHEREAS, the City administration has received several complaints from City
16 merchants and residents in regard to the increased cost of temporary full road and
17 sidewalk closure permit fees; and,

20 WHEREAS, the Mayor and City Commission have requested to review the

23 NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY

Section 2. If any section, clause, sentence, or phrase of this ordinance is for any
reason held invalid or unconstitutional by a court of competent jurisdiction, the holding
shall not affect the validity of the remaining portions of this ordinance.
Section 3. All ordinances or parts of ordinances in conflict with the provisions of
this ordinance are repealed.
Section 4. This ordinance shall take effect immediately.

AN ORDINANCE OF THE MAYOR AND T14E CITY COMMISSION
OF THE CITY OF SOUTH MIAMI, FLORIDA RELATING TO THE
FEE SCHEDULE; AMENDING ORDINANCE 44 -08 -1979 AND 55-
08 -1990 AS AMENDED BY ORDINANCES TO, INCREASING
SOME FEES, ADDING NEW FEES AND DELETING SOME FEES
FROM T14E SCHEDULE, PROVIDING FOR SEVERALBILITY,
ORDINIANCES IN CONFLICT, AND AN EFFECTIVE DATE;
WHEREAS, the City has reviewed fees schedules for Miami -Dade County and
several municipalities; and,
WHEREAS, the City has found that fees for the County and other
municipalities are higher than those fees included in the South Miami Fee Schedule;

WHEREAS, the cost of services for Planning; Building; Parks & Recreation;
Public Works; Central Services and other related fees has increased considerably in the

Section 2. if any section, clause, sentence, or phrase of this ordinance is for any
reason held invalid or unconstitutional by a court of competent jurisdiction, the holding
shall not affect the validity of the remaining portions of this ordinance.
Section 3. All ordinances or parts of ordinances in conflict with the provisions of
this ordinance are repealed.
