8CITY OF SOUTH MIAMI INTER - OFFICE MEMORANDUM TO: City Commissioners DATE: February 2, 2010 IWO'` VIA: Laurence Feingold, City Attorney A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA DECLARING THAT IT IS THE POLICY OF THE CITY OF SOUTH MIAMI TO NOT DO BUSINESS WITH ANY VENDORS DOING BUSINESS WITH IRAN OR SUDAN OR ANY TERRORIST COUNTRY OR GROUP; PROVIDING AN EFFECTIVE DATE. [:I ki FLO) -, All too often I have become aware that numerous large companies continue to do business with foreign countries or other groups that support terrorism. It appears that these big corporations do not have a conscience. Yet, the same corporations bid on public projects and otherwise seek to become vendors supplying their products or services to various cities. The City of South Miami is a municipal corporation, but we do have a conscience. Under the above resolution, it would be deemed unconscionable for the City of South Miami to use public funds to pay for services or products from companies that have business operations in or with foreign countries or other groups that sponsor terrorism and commit egregious human rights violations. To ensure that we don't boycott a company that is not involved with terrorism, by mistake, I have required that the companies we boycott are those companies that are determined to be terrorists by the United States government. Thus City funds can never be used to pay companies that support terrorism in any part of the world. I RESOLUTION NO. 2 3 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF 4 THE CITY OF SOUTH MIAMI, FLORIDA DECLARING THAT IT 5 IS THE POLICY OF THE CITY OF SOUTH MIAMI TO NOT DO 6 BUSINESS WITH ANY VENDORS DOING BUSINESS WITH IRAN 7 OR SUDAN OR ANY TERRORIST COUNTRY OR GROUP; 8 PROVIDING AN EFFECTIVE DATE. 9 10 WHEREAS, numerous companies continue to do business with foreign countries 11 or other groups that support terrorism; and 12 13 WHEREAS, the City Commission finds that it is unconscionable for the City of 14 South Miami to use public funds to pay for services or products from companies that 15 have business operations in or with foreign countries or other groups that sponsor 16 terrorism and commit egregious human rights violations; and 17 18 WHEREAS, as a result of this Resolution, if acted upon, none of the City's 19 dollars will support either the genocide in Sudan, or Iran's development of nuclear 20 weapons or any other terrorist groups. 21 22 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY 23 COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA, THAT: 24 25 Section 1. The recitals and findings contained in the Preamble to this 26 Resolution are adopted by reference and incorporated as if fully set forth in this Section. 27 28 Section 2. The City Commission adopts as its official policy to not do 29 business with any vendors doing business with Iran or Sudan or any terrorist country or 30 group determined to be on the terrorist list by the United States. 31 32 Section 3.
