Carlton, Acting City Manager Murray Park Comprehensive Swimming Facility Update 6 Subiect A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA, AUTHORIZING THE CITY MANAGER TO COMPLETE THE MURRAY PARK SWIMMING FACILITY DESIGN; PROVIDING FOR AN EFFECTIVE DATE. Purpose of Report This detailed report will provide you with the necessary information to determine the future of the proposed Murray Park Swimming Facility. In this report you will find a brief history of the project, the funds secured, projected construction cost, the Building and Operations/Projected Revenue figures, the necessary steps and recommendations towards successful project completion, and any challenges that may need to be overcome to complete this project. History Since 1973 when Commissioner Spike Gibson brought up the subject, residents have been requesting a pool at Murray Park. It wasn't until multiple drowning incidents, with the most recent occurring approximately 15 years ago, that the project became a priority for the City of South Miami. In 1994, a group of residents formed a development committee who began to survey the entire City of South Miami. As a result of their findings, they prepared a set of plans that encompassed the entire needs of the community with regards to their desired recreational services. Later, after a change of City Commission and Administration, the plans were revised and the pool was deferred. The Gibson - Bethel Community Center was completed in September 2003 and can only be described as a success and wonderful asset to the entire community. Following the completion of the community center project, a master plan was created and a pool feasibility study was conducted for Murray Park. The plan was completed and presented to the City Commission in 2004. At that time, funding for the project was sought and design funds were soon secured. Since 2004, significant amounts of funding have been secured for the purpose of building the swimming facility. Page 2 of 6 In October 2008 a firm was selected to design the swimming facility. After offering a public workshop, meetings with the Parks & Recreation Board, and extensive meetings with City Staff, the needs of the pool were defined and a design has been completed for the Murray Park Swimming Facility. Today, 100% construction documents are ready and we are now awaiting a final go ahead on the future of the Murray Park Swimming Facility Project. Funds Secured As of January 15, 2010, we have secured $1,166,911 towards the construction of Murray Park Swimming Pool and $326,000 for the design of the facility for a total of $1,492,911. Below is a breakdown of the funding amounts, sources and any purposed use of the funds. Estimated OneratinII/Revenue Figures — (Projected to begin FY 11 -12) Projected Annual Operating Expenses $ 341,700 Projected Annual Revenue $ 54,568 Annual Opinion of Facility Operations ($287,131) See attached chart for details. Proiect Challenges (1) Requirement by MDWASD to increase water main to 12 ". The City of South Miami is required to provide Water and Sewer connections to the proposed swimming pool location. A 6 inch water main exists on SW 68`x' Street but the size Page 3 of 6 is insufficient and connection to it is not allowed. A new 12 inch water main ($140,000) is required by MDWASD in order to close the water main loop. Fire code requires the increase of the water main in order to achieve 3,000 gallons per minute fire flow. The City will be required to upgrade the water main. In addition the nearby sewer pump station is inadequate and needs capacity upgrades. MDWASD will perform the necessary upgrades to the pump station in 2014, which is too long a time frame for our projected completion. As a result of the information above, we will be presenting the case to the DERM Environmental Quality Control Board (EQCB). The case will request a variance to allow an on -site septic tank that would extend into the existing ball field at Murray Park since septic tanks are not allowed under parking. This is the least costly solution estimated to cost $70,000. The City Manager has commenced talks with the CRA in order to have a portion of their available funds to be used for both the water and sewer infrastructure projects. (2) Pending Green Building initiatives to be incorporated into plans in an effort to seek "Silver" LEED certification. We have reminded OTS that "Green Building" and LEED certification are part of their scope of work and were committed in their presentation to the City Commission. The cost of construction to achieve LEED certification is not included in the present construction estimates. It is recommended that we finalize the additional cost estimate and that CRA available funds be used for this purpose as well. Green Building Initiatives are being incorporated into the designs with a goal of achieving a LEED Certification at a "Silver" Level. Although there have been no pools in the nation found to carry this certification, we are working hard to maximize the Green Initiatives in the proposed building. Since LEED certification for this sort of building is hard to reach, we will take all necessary strides to make the proposed building designs as "Green" as our budget will allow and bring the entire set of plans to you as a complete project for your final approval as soon as they are finalized. (3) Reducing the effect of the annual operating costs on the City's Operating Budget. Annual net operating costs for the pool will be approximately $287,000 beginning in FY 2011/12. We believe that sponsorships and other sources could possibly reduce this to $250,000 and this Administration would work diligently to achieve this goal. The strategy would be to budget a portion of this money in FY 2010/11 to cushion the full amount needed in FY 2011/12 and to develop a program that will utilize CRA funds for approximately half of the need in FY 2011/12 with the CRA funding being reduced gradually over the next five fiscal years. Extensive marketing programs are also needed. Using this facility during non- peak times and effective programming /scheduling will offer another much needed opportunity to offset the annual operating costs. It is also critical to ensure that the pool be viewed as an asset and a source of recreation for the entire community and the marketing program will be geared to achieve that goal without excluding City residents from desired pool usage. Extensive Marketing Programs are needed. Using this facility during non -peak times and effective programming /scheduling will offer another much needed opportunity to offset the annual operating costs. The opportunities to work with the School Board and the University of Miami will be fully explored. It is also critical to ensure that the pool be viewed as an asset Page 4 of 6 and a source of recreation for the entire community and the marketing program will be geared to achieve that goal. Estimated Proiect Schedule ➢ 1/26/10 — Approval of moving this project forward as recommended. ➢ 2/10 — Submit WASD, DERM, and Department of Health Permits (may take up to 6 -8 months) ➢ 7/10 — Final Bid preparation (to be done while final permits and approvals are attained) ➢ 8/10 — Bid period begins — 60 days ➢ 10/10 — Review and Negotiation of Construction Award. ➢ 10115110 - Contractor Notice to Proceed and Pre - Construction Meeting /Groundbreaking ➢ 9/15/11 — Final Project Completion Issues Raised at City Commission Meeting on January 26, 2010 1. It was mentioned that the Community Action Agency (CAA) of South Miami contributed $200,000 toward the Murray Park Swimming Pool Project. The CAA receives $100,000 per year for use on projects it recommends. The CAA allocated 2 years of this funding ($200,000) to the pool project. This was included under the monies provided by the County in the $756,911 amount listed as provided through the Miami -Dade County Department of Housing and Community development. I apologize for not recognizing the contribution of the CAA to this project. 2. There was mention of possible use of Weed and Seed funds for the operating costs of the swimming pool. This is a good suggestion and will be pursued. 3. It was asked which other swimming pools were considered in the development of the yearly maintenance costs of the Murray Park Swimming Pool. Per our consultants, OTS, the costs were based upon the maintenance expense for the Martin County Aquatic Park. 4. A request was made for the minutes of the meeting of the Parks & Recreation Board in which they discussed the Murray Park Swimming Pool Project. These have been attached. 5. There was discussion regarding the Miami -Dade County Water and Sewer Department's request that the City increase the size of the water main serving the Murray Park Swimming Pool Project. The request from WASD was made in a letter dated December 7, 2009 (copy attached). Recommended Course of Action 1. Give the "go ahead" decision to complete biddable documents, receive bids, and start the permitting process. A final decision would be made by the City Commission concerning the additive alternates and the LEED /Green costs when the prices are in. 2. Authorize the Acting City Manager to continue meeting with DERM and WASD to negotiate the terns and expedite the work of connectivity for water supply and sewage disposal. 3.Authorize the Acting City Manager to continue negotiating with the CRA to aid with the cost of the septic tank at a cost $70,000, the water pipe extension at a cost of $140,000, the LEED /Green Costs, and the declining annual financial program commitment towards this Page 5 of 6 project. It is expected that a detailed item will be brought to the CRA board during March 2010 to define the total CRA support for this project. The implications of a "no -go" decision on this project could include that fact that we may have to pay back the expended portion of the design costs which will be approximately $175,000 and our credibility for future project funding will be greatly diminished at best. Therefore, within the limits of the steps defined above, your "go for it" decision is strongly recommended. Conclusion It is important to acknowledge the extraordinary effort by County Commissioner Gimenez and the Miami Dade County DHCD for providing nearly 95 percent of the capital funds for this project. It is also important to remind the City Commission that the USDHUD is putting extreme pressure on the County to get these funds to work which means that a construction contract has been signed. The implications of a "no -go" decision is that we may have to pay back the expended portion of the design costs which will be approximately $1.75,000 and our credibility for future project funding will be greatly diminished at best. Therefore, within the limits of the steps defined above, your "go for it" decision is strongly recommended. WHEREAS, it is necessary and desirable to improve the quality of life, to benefit property values, to promote prevention of juvenile crime by providing positive recreation opportunities, and to improve the recreation facilities for youth, adult, and senior citizens in this community through the improvement of our parks and natural areas; and WHEREAS, the City of South Miami Parks and Recreation Department desires to continue providing site improvements to Murray Park with the addition of a swimming pool to address the long standing requests by residents for a pool; and WHEREAS, pending issues including proper water and sewer disposal, Green Building Initiatives, and estimated net operating costs; and WHEREAS, the proposed swimming pool building is to be constructed using green technology to the greatest extent possible; and WHEREAS, the City Commission of the City of South Miami desires to approve the next steps in the process of bidding and construction of the proposed swimming pool. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA THAT: Section 1. Direct the City Manager to: A. Develop a detailed marketing plan that will bring in significant revenues, while ensuring non- paying groups and individuals can fully utilize the facility. B. Begin the permitting process through other agencies, such as the Florida Department of Health, Miami -Dade County Department of Environmental Resources Management, Miami -Dade County Fire Department, Miami - Dade County Water and Sewer Department and others as may be required. C. Work with the SMCRA Director and the SMCRA Board to bring in funding for infrastructure serving the project and for assistance in the initial operating costs. D. Let the proposed swimming pool out to bid with additive alternates maximizing the "green" efficiencies for the building. E. A shared payment between MDWASD and City of South Miami may be an option. 1.05 A second option is to construct a private on -site pump station and connect All to note and install an 8" forcemain to an existing 18" forcemain owned by MDWASD. , 1.06 A third option is to request a code variance through the DERM City of Environmental Quality Control Board (EQCB) to allow an on -site septic South tank. The attempt of a "Silver" category is to be attempted for certification. C3TS stated that CSM has requested at 50% Construction Documents that substitution of fixtures for sustainable design. C3TS stated that fixtures and substitutions will be provided for 100% Construction Document submittal and substitutions are to be a revision to the model number or sustainable category of the product. Certification of Building will require additional time and cost which CSM stated that deadline is to be met and certification of building will be offered in a proposal by C3TS. An attempt to have the plans processed throu h ermitting and receive bids by June 2010. 1.10 Planning and Zoning stated that at the moment there are no discrepancies and will continue review of plans. 1.11 C3TS stated that a 6" watermain exists on SW 68' Street but the size is All to note insufficient and connection to it is not allowed. A new 12" water main is required by MDWASD in order to close the watermain loop. CSM will be required to extend the water main. Mr. Citarella inquired Mr. Garcia the requirement of the 12" water main when a proposed pool project will not require high use of water and to utilize existing. Mr. Garcia stated that fire code requires the increase of the water main in order to achieve 3,000 allons oer minute fire flow. 1.12 CSM requested WASD to perform the necessary upgrades. MDWASD stated that the watermain extension is CSM's responsibility. 1.13 Gravity sanitary sewer mains exist on SW 68t Street and SW 58 Place. The receiving pump station is #177 which is behind City Hall. Existing Pump Station #177 is in moratorium due to excess pump running times and no new gravity connections'are permitted. Mr. Garcia stated that the existing pump station is permitted to be in operation for a maximum of ten (10) hours per day and it is out of compliance by operating above stated hours. CSM requested MDWASD to perform the necessary upgrades. MDWASD stated that upgrades are expected to occur in 2014. 1.14 CSM requested MDWASD to perform the necessary upgrades to the pump station. MDWASD stated that the projected work is to occur in 2014. 1.15 C3TS stated three options for the sewer connections to the pool project. All to note A. Upgrade pump station #177 in order to release the moratorium status and allow additional sewage flow. Work is costly and is not scheduled until 2014. B. Provide private on -site Pump Station with a forcemain extension to Commerce Lane. DERM will require that the private pump station and forcemain be abandoned when PS #177 is upgraded and ready for additional sewage flows. Pump Station and forcemain will be costly and will require space on an already tight site C. Present the case to DERM Environmental Quality Control Board (EQCB). Construction Documents indicate that the Swale north of the pool will accept p ool water. 1.17 C3TS will require is to review option C and provide proposal for additional C3TS scope of work. 1.18 Mr. Citarella requested alternates to be proposed as Deduct Alternates. C3TS agreed. 1.19 CSM and C3TS will require to review plans for value engineering. Mr. Carlton requested that value engineering to be reviewed carefully not lowering the uality of the products for the patrons and the city residents. 1.20 CSM provided C3TS with letter by CSM Jose Olivo to Ramon Casteila in reference of Work Order Authorization for record of delivery. Action 1E7�jERAG: 1.01 Meeting was held to gather ideas for the proposed Aquatic Center and review preliminary design master plans to the Parks & Recreation Board members. 1.02 The presentation is commenced with introductions and approval of the City of South Miami to review the design. 1.03 C3TS presented their experience and programs of other similar projects. The project was approached with providing the requirements for the Teaching /therapy; 8 lane competition and Water Activity Pools including a concession area, administration offices and conference room. 1.04 C3TS presented master plans of proposed site plans A -2A; A -213; A -2C & All to A -2.D See attached). note 1.05 Proposed Site Plan illustrated designs for revenue and minimal maintenance.
