An Ordinance amending Section 15-80 of the City of South Miami's Code of
Ordinances.
WHEREAS,Section 15-80 of the City of South Miami's Code of Ordinances states:
"It shall be unlawful for any person,by himself orby the operation of any
instrument,agency or vehicle,to make any unnecessary or unseemly noises within
one hundred (100)feet of any portion of the grounds and premises on which is
located a hospital or other institution reserved for the sick,or any school during
school hours.Thecity manager shall place as many signs ashe may deem proper
within ornear zones hereby created,calling attention tothe prohibition against
unnecessarynoiseswithinsuchzones.";and
WHEREAS,the ordinance,inits current form,does not address the main concern of
unnecessary or unseemly noise-its audible perceptibility;and
WHEREAS,theSection 15-80 should be amended toprovidemorespecificcriteria.
NOW,THEREFORE,BEIT ORDAINED BYTHE MAYOR ANDCITY
COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA:
Section1:Section 15-80 oftheCityof South Miami's Codeof Ordinances shallbe amended
to read as follows:
Sec.15-80.-Same—Near hospitals and schools.
Itshallbeunlawfulforanyperson,by himself orbytheoperation of any
instrument,agencyorvehicle,tomakeanyunnecessaryorunseemlynoisesthat
are clearly audible withinonehundred (100)feet of any portion of the grounds
and premises onwhichislocatedahospitalorotherinstitutionreservedforthe
sick,orany school during school hours.Thecity manager shall place asmany
signsashemaydeemproperwithinornearzonesherebycreated,calling attention
tothe prohibition against unnecessary noises within suchzones.
Section 2:Codification.The provisions of this ordinance shallbecomeandbemadepart
of the Code of Ordinances of theCity of SouthMiamias amended;that the sections of this
ordinance maybe renumbered or re-lettered to accomplish such intention;and that theword
"ordinance"may be changed to "section"or other appropriate word.
Section 3.Severability.If anysection,clause,sentence,or phrase of this ordinance isforany
reasonheldinvalidorunconstitutionalbyacourt of competent jurisdiction,thisholdingshallnot
affectthevalidity of theremainingportions of thisordinance.
Section 4.Ordinances in Conflict.All ordinances orparts of ordinances andall
sections and parts of sections of ordinances in direct conflict herewith are hereby repeated.
However,itis not the intent of this section to repeal entire ordinances,orpartsof ordinances,
that give the appearance of being in conflict when the two ordinances can be harmonized Or

whenonlyaportion of theordinanceinconflictneedstoberepealedtoharmonizethe
ordinances.If the ordinance in conflict canbe harmonized by amending its terms,itishereby
amended to harmonize thetwo ordinances.Therefore,only that portion that needstobe repealed
to harmonize the two ordinances shall be repealed.
Section 5.Effective Date.This ordinance shall become effective upon enactment.
