RESOLUTION NO.127-14-1 4221 A Resolution for special use approval to permit a general restaurant at 5701 Sunset Drive,Shops at Sunset Place Unit CUD,within the Specialty Retail "SR",Hometown District Overlay "HD-OV". WHEREAS,pursuant to Section 20-3.4(B)(4)(b)of theLand Development Code(LDC), theapplicant,JJMarauders,LLCsubmittedApplicationNo.PB-14-006 tothePlanningBoard requestingaSpecialUseApprovaltooperateageneralrestaurantlocatedat5701SunsetDrive, ShopsatSunsetPlaceUnit CI ID,withintheSpecialtyRetail "SR",Hometown District Overlay "HD-OV"zoning district;and WHEREAS,the applicant proposes totakeovera portion of an existing vacant space that will front on SW 57th Avenue (Red Road);and WHEREAS,restaurants are permitted asaspecialuse within the Specialty Retail"SR", Hometown District Overlay "HD-OV"zoning district andis subject to meeting general conditions specified inLDC Section 20-5.8 and subject to meeting special use requirements set forth in LDC Section 20-3.4(B)(4)(b);and WHEREAS,the applicant's restaurant special use meets the special use requirements set forthinLDC Section 20-3.4(B)(4)(b)which are i.Allsuch establishments shall provide only inside or patio service on private property.Public streets,rights-of-way,sidewalks and required setbacks may notbe used for patio or street-side services of anykind. ii.No services of a drive-in or of afastfood nature shall be permitted. iii.Thecity commission shall review and recommend approval,disapproval or modification of allsiteplansand project specifications forthis special use permit;and WHEREAS,the approval of aspecialuse requires a recommendation fromthe Planning Boardandthe approval of theCity Commission aftera public hearing;and WHEREAS,atthe June 10,2014 Planning Board meeting,and following a public hearing,the Board reviewed application PB-14-006 and voted 6ayes,0naysto recommended approval of the request fora special useto operate a restaurant;and WHEREAS,theCity Commission desiresto accept the recommendation of the Planning Board. OnApril 1,1997,the City Commission approved ResolutionNo.64-97-10035,allocating the Shops at Sunset Placeatotal of 61,250square feet of restaurantspace.Parking calculations were basedon these spaceallocationsfor all the usesin the Shops.With the addition of the 1,400square feet forJimmyJohn's,the totalrestaurantsquare footageat the Shops is44,723squarefeet;arearemainingforrestaurantuseis16,528 square feet.
