A Resolution declaring that the personal property,described in the attached
list,is "surplus"and authorizing the City Manager to sell the "surplus"items at
auction.
WHEREAS,Section 2-4.7 titled:"Surplus city-owned property"of the City of
South Miami Code of Ordinances states that all personal property owned by the City shall not be
sold unless and untilitis declared to be surplus property by resolution of the City Commission;
and
WHEREAS,the City Manager is recommending that the attached listof personal
property items beclassifiedas "surplus"because said property serves nouseful function forany
activityorinanylocationwithin the City andshouldbesoldto the highestbidderbywayofa
City auction or as otherwise provided in section 2-4.7of the CityCode of Ordinances;and
NOW THEREFORE BEIT RESOLVED BYTHE MAYOR AND CITY COMMISSION OFTHE
CITYOFSOUTH MIAMI,FLORIDATHAT;
Section1.Thepersonalpropertydescribedintheattachedlistofpropertyis"surplus"
and City Managerishereby authorized to dispose oftheitemsin accordance withtheprocedure
set forth in section 2-4.7of the CityCodeof Ordinances.
Section2.Severability.Ifany section,clause,sentence,orphraseofthisresolutionis
for any reason held invalid or unconstitutional by a court of competent jurisdiction,this holding
shallnot affect the validityof the remaining portions ofthis resolution.
Section3.Effective Date:This resolution shall takeeffect immediately upon approval
by the City Commission

Personal Property isdefined as temporary or movable property.
Any personal property that isclassified obsolete,ornolonger
economical or efficient to keep,or that serves no useful function for
any activityorin any locationwithin the City,needs to be declared
as "surplus"by the City Commission per Section 2-4.7 of the Code
of Ordinances.
Section2-4.7 titled:"Surplus city-owned property"ofthe City of
South Miami CodeofOrdinances states thatallpersonal property
owned by the City shall not be sold unless and untilitis declared to
besurpluspropertyby resolution ofthe city commission.The City
Managerisrecommendingthatthe attached listofpersonal
property items be classified as "surplus."While some ofthe
personal propertyitems declared surplus are ingoodorfair
condition,theyserveno useful function forany activity or in any
location within the City and should besoldtothe highest bidder by
way ofaCity auction.

Sec.2-4.7.-Surplus city-owned property.
(a)Itemsofpersonal property ownedbythe city shallnotbesoldunlessand until itisdeclaredtobesurplus
property by resolution of the city commission.
(b)Thecity commission shallnot consider declaringanyitemof personal propertytobe surplus unless thecity
manager has affirmatively recommended such action thereon.
(c)Upondeterminationbyresolutionbythecitycommissionthatanitemof personal propertyissurplus,thecity
manager isherebyauthorizedtoselltothehighestbidderatpublic sale or,ifapprovedbythecommissionby
resolution,atpublicauction,saiditemof personal propertyafteradvertisingthedate,timeandplaceofsaid
sale orauctiononceaweekforthree(3)consecutiveweeksina newspaper of general circulationinthecity.
Thecity manager shallhavetherightto accept orrejectanyorallbids.Intheeventthe personal propertyshall
beofferedforsaleorauction,andnobidsshallbereceivedtherefor,itshallbedeemedthatsuchpropertyhas
novalueandthecity manager inhisdiscretionmay order it destroyed or otherwise disposed of.
(d)Thissectionshallnotapplytostolen,abandoned orconfiscatedpersonalpropertywhichhascomeintothe
city's possession.
