Res No 122-14-14216RESOLUTION NO.122-14-14216 A Resolution declaring that the personal property,described in the attached list,is "surplus"and authorizing the City Manager to sell the "surplus"items at auction. WHEREAS,Section 2-4.7 titled:"Surplus city-owned property"of the City of South Miami Code of Ordinances states that all personal property owned by the City shall not be sold unless and untilitis declared to be surplus property by resolution of the City Commission; and WHEREAS,the City Manager is recommending that the attached listof personal property items beclassifiedas "surplus"because said property serves nouseful function forany activityorinanylocationwithin the City andshouldbesoldto the highestbidderbywayofa City auction or as otherwise provided in section 2-4.7of the CityCode of Ordinances;and NOW THEREFORE BEIT RESOLVED BYTHE MAYOR AND CITY COMMISSION OFTHE CITYOFSOUTH MIAMI,FLORIDATHAT; Section1.Thepersonalpropertydescribedintheattachedlistofpropertyis"surplus" and City Managerishereby authorized to dispose oftheitemsin accordance withtheprocedure set forth in section 2-4.7of the CityCodeof Ordinances. Section2.Severability.Ifany section,clause,sentence,orphraseofthisresolutionis for any reason held invalid or unconstitutional by a court of competent jurisdiction,this holding shallnot affect the validityof the remaining portions ofthis resolution. Personal Property isdefined as temporary or movable property. Any personal property that isclassified obsolete,ornolonger economical or efficient to keep,or that serves no useful function for any activityorin any locationwithin the City,needs to be declared as "surplus"by the City Commission per Section 2-4.7 of the Code of Ordinances.
