Ord No 11-14-2189ORDINANCE NO.11 -14-2189 An Ordinance amending Section 20-2.3 -Definitions,to include a definition for Temporary Structures and Section 20-3.6(1)titled Accessory Structures or Uses WHEREAS,theCity Administration requestedthatthe Planning Department addresstheissue of temporary structures intheland development codeby providing a definition and regulations;and WHEREAS,after review of similar regulationsfrom other municipalities,itwasdeterminedthat temporarystructuresaregovernedbytheFloridaBuildingCode,givingtheBuildingOfficialauthorityto issue permits;and WHEREAS,thelanddevelopmentcodeprovidesthatthePlanningBoardshallperiodically reviewandmake recommendations onprovisions of theCode;and WHEREAS,thePlanningDepartment recommends theinclusion of theproposedlanguageto address temporary structures;and WHEREAS,attheirApril8,2014PlanningBoardmeetingfollowingapublichearingon application PB-14-005,theboardvoted 4-ayes and 1-nay to recommend approval ofthe proposed ordinance,as amended,tothe City Commission;and WHEREAS,theCity Commission isdesirousofacceptingthePlanningBoard's recommendation. NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA: Section1.Section 20-2.3 and Section 20-3.6(1)oftheCityof South Miami Land Development Code is hereby amended to read as follows: 20-2.3 -Definitions Temporary Structure,shallincludeapermittedstructurethatiswithoutafoundationor footings,thatis not constructed inthe public right of way?without a foundation or footings and thatis either portable or easily disassembled. *** 20-3.6-Supplemental Regulations (I)Accessory Structures orUses (1)No accessory structure shall be constructed upon a lot until construction of the principal structure or use has commenced. (3)Noaccessorystructuresorusesshallbelocatedwithinanyrequiredyardsetbackarea, exceptas permitted insubsection(4)below. (4)Accessorystructuresorusesmaybelocatedinarequiredrearyard,providedsuch structures orusesdonotoccupymorethanthirty(30)percent of requiredsetbackareas andprovidedfurtherthatsuchaccessorybuildingsdonotexceedone(1)storyortwelve (12)feetin height above grade. (5)Accessory structures orusesshallbelocatednotlessthanfive(5)feetfromanyrearor side lotline.No accessory structures oruses shall be located in the required setbacks that are adjacent toa street right-of-way line;norshallany accessory structures be located less than five(5)feet fromany rear lotline. (6)Canvas tents and cabanas,usedfor temporary shelter andnot containing cooking facilities,shallbe subject tothe accessory structure regulations. (a)Temporary Structures. (1)The building officialis authorized toissueapermitfor temporary structuresandusesthatarenot constructed within the public right-of-way.Permits shallbe limited asto time of service,but shallnotbe permitted formorethanonehundredandeighty (180)days.The building officialis authorized to grant extensions for demonstrated cause. (2)Temporarystructuresshallbesubjecttothelocationrequirementsforaccessorystructures.The city manager or designee may authorize an alternate location of said structure for demonstrated cause. Section2.Codification.The provisions ofthis ordinance shall become andbemadepartofthe Code of Ordinances oftheCityof South Miami as amended;thatthe sections ofthis ordinance may be renumbered or re-lettered to accomplish such intention;and thatthe word "ordinance"may be changed to "section"orother appropriate word. Section 3.Severability.If any section,clause,sentence,or phrase of this ordinance isfor any reason held invalid or unconstitutional bya court of competent jurisdiction,this holding shall not affect thevalidity of theremainingportions of this ordinance. Section4.Ordinances inConflict.All ordinances orpartsof ordinances andallsectionsand parts of sections of ordinances in direct conflict herewith are hereby repealed.However,itisnotthe intent of this section to repeal entire ordinances,or parts of ordinances,that give the appearance of being in conflict when thetwo ordinances can be harmonized or when only a portion ofthe ordinance in conflict needs to be repealed to harmonize the ordinances.If the ordinance in conflict can be harmonized by amending its terms,itis hereby amended to harmonize the two ordinances.Therefore,only that portion that needs tobe repealed to harmonize the two ordinances shall be repealed.
