If so, then Item 2 would be a moot point since the ERPB by ordinance, provides site plan approval for new construction. Secondly, if this is being reviewed by the ERPB, does it assume that it is skipping the preliminary review and going right to final with full construction drawings? If it goes to final and the board recommends additional changes or modifications, the project potentially could be delayed while the developer makes the requested changes, unless the Board would not have the right to make changes. Execution of this agreement shall constitute final site plan approval of the Site Plan attached as Exhibit B, subject to Architectural Review, and the Developer may proceed to obtain building permits for construction in substantial compliance therewith in accordance with City zoning and building regulations in effect as of March 20, 2012. 2. Architectural Review. The Developer shall construct the project depicted in Exhibit B in substantial compliance with the color rendering included at Exhibit B except that the Developer shall accommodate reasonable modifications to architectural features, material selection or colors requested by the City’s Environmental Review and Preservation Board (ERPB) if the ERPB provides review and comment on or before September 4,December ___, 2012. This provision for expediting ERPB review is subject to Developer diligently submitting plans to the ERPB and providing satisfactory and immediate responses to questions of the board.
