I re-measured the heights on the rear portion (northern lot) of the proposed structure where it steps down from seven stories, and based on the definition of "story" in the TODD, I have determined it meets the requirement of a two story height in the MU-4. That being said, Section 6(b) of the proposed FLUEDRA Agreement, which deals with the "height adjustment to the MU-4 zoning district, will need to be modified at the Commission meeting to reflect "...and then decreasing to 3 2 stories at the rear of the Project." Although the plans show three (3) parking levels, they are contained within two (2) stories of the proposed building. ARTICLE VIII. TRANSIT-ORIENTED DEVELOPMENT DISTRICT Sec 20-8.2 Definitions Story: The horizontal division of a building between the surface of a floor and the surface of the next floor above, or the next ceiling if there is no floor above. For the purposes of these regulations, a story shall be interpreted as each vertical unit of fourteen (14) feet maximum, e.g. a one-floor cinema twenty-two (22) feet tall shall be considered a two-story building.
