Jim and Lyman,
Here is a revised version of the Agreement as discussed during our
meeting on July 30th. The difference between this and the one
circulated earlier is, per Lyman's request, the addition of the FHFC
application as an Exhibit and deletion of any reference to setback
adjustment. Specifically:
* added a whereas clause acknowledging the award of credits and
attaching the application for information purposes;
* Revised the exhibits provision to indicate that Exhibit D (the
FHFC application) is not part of the agreement, but for informational
purposes only
* Deleted paragraph 6 c (setback)
* Tweaked the whereas clause describing the split zoning problem
to make more clear that the canyon effect was an aesthetic problem for
the neighborhood, not the project.
I am circulating this draft for discussion, but the changes are subject
to my confirming that Don had agreed to attach the FHFC application. I
have an inquiry out to him now. Once we know whether this draft is
"final" for purposes of our 1:30 meeting and status conference with Mr.
Baird, we can perhaps forward it and the site plan documents I sent last
week to Mr. Baird so he can review before the 2:00 call.
