Pursuant to Section 20-5.12(F) of the City's land development code, the department
reviewed the proposal for the Phase 2 of Parkside Village planned unit development
(PUD), originally approved in 1997.
F!arkside Village is a detached single-family development that was proposed to be
developed in two phases. Phase I was developed with 16 units; Phase 2 to be developed
Parkside Village PUD -h'; Phase 2 Review

with 4 units, for a total •i i i units. Final plat approval for Pha i
by the City Commission on November 19, 2013, Resolution 248-13-14066�
The question arose whether the proposed revision to the 1997 site plan constitutes a
major change the Section 2- 5.12() of the City's Land Development Code. Section
(a)(1) of resolution 136 -97- 10106 states:

Please accept this application requesting approval • proposed amendments to the
site plan for "Parkside Village." Parkside Village is a Planned Unit Development,
designated PUD-R on the City's official zoning map, and governed by Resolution No,
136-97-10106, passed and adopted by the City Commission on July 22, 1997 (the
"Resolution"). The Resolution includes the following condition:

(1) Two (2) common trash pickup areas within the development, as shown on the
2014 plan, to reduce the demand on trash pickup vehicles to back-up and
reduce the demand on drivers to exit the vehicles to perform their duties.
(2) Provision of 20'wide driveway width within Phase 2 in lieu of the 18' drivew
indicated on the 1997 plans. I

Agreement of Cooperation
For Parkside Village Phase 21
This agreement is entered into by and bet-ween HerrMatt Homes, LLC, a
Florida limited liability company ("HMH") and Parkside Village Homeowners
Association, Inc.i a Florida not-for profit corporation ('HOA").
Miereas, Parkside Village is a Planned Unit Development ("PUD-)
established by Resolution Number 136-97-10106 ("Resolution') adopted by the
City Commission of the City of South iam, Florida, on July 22, 1997;

Whereas, Lhe PUD is governed by the Declaration of Covenants, Restric-Lions

and Easements for Parkside Village recorded in ORB 18183 beginning at page 3439
of the public records of Miami-Dade County, Florida ("Declaration");
whereas, the PUD consists of 16 existing homes and 4 homes to be built on
the Additional Property as defined in tbe Declaration- the 16 existing omes
comprise Phase 1 of the PUD, ind the 4 homes comprise Phase 2 of the PLID;
Whereas, [IMH, the Declarant under Declaration by viMe of an assignment

from the original Declarant, Parkside Village Limited, date June 5, 2013, intends to
build 4 homes in Phase 2;
Whereas, HMH has provided Lo HOA the Site Plan for PhAse 2 (Exhibitfii),
bloor Plan and Roof Plan for Model C (Exhibit 13)) Elevation Renderings of Model C
(Exhibit Q, Preliminary Landscape Plan for Phase 2 (Exhibit D), proposed Trash
Collection Plan (Exhibit E) and the Tentative Plat for Phase 2 (Exhibit
Whereas, HOA seeks to minimize any additional burden on the use and
occupancy of Phase 1, including but limited to parking, trash collection, drainage
and irrigation by development of Phase2; and
Whereas, HO A and HMH have worked together to resolve the aforesaid
issues as provided for in this agreement.
In consideration of the foregoing and the mutual covenants herein contained,
in the event IIMH commences development for and construction of the four hornes
