Resolution approving a plat to allow for the Subdivision of the property
located at 5980 SW 81 Street, South Miami, Florida.
WHEREAS, Fifty-Nine Investments LLC, owner of the parcel located at the 5980 SW 81 st
Street, submitted a Tentative Plat to Miami Dade County, application No. T-23428-2-COR, pursuant to
Section 28-4 of Miami Dade County Code; and
WHRERAS, the Miami Dade County plat committee met on November 27, 2013 and
recommended approval of the tentative plat subject to any provisions enumerated in their approval letter,
and subject to final plat approval by the City and County; and
WHEREAS, the replat application requests a subdivision of said parcel into two buildable single-
family lots; and
WHEREAS, the replat is in compliance with the City's requirements within the RS-3, single-
family zoning district.
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF
THE CITY OF SOUTH MIAMI, FLORIDA:
Section 1. The application submitted by Fifty-Nine Investments, LLC, requesting approval of a
proposed Final Plat for the property legally described in Section 2, pursuant to section 20-4.2(b) of the
Land Subdivision Regulations is hereby approved , and subject to the following
conditions, and/or other conditions deemed appropriate by the City Commission:
1. Compliance with the conditions of the Miami-Dade County approval of application No.
T -23428-2-COR;
2. Compliance with current City Land Development Code requirements.
3. Compliance with the City's tree removal and canopy mitigation requirements.
4. Compliance with the City's Public Works requirements for any driveways, sidewalks or other
improvements.
5. Demolition of the existing one-story structure prior to issuance of a development permit.
6. Compliance with any Miami-Dade County Environmental Resource Management requirements
prior to final recording of this plat.
Section 2. Legal Description
The west 128.47 feet of Tract 13 less the south 100 feet thereof, revised plat of the amended
portion of the amended plat of Palm Miami Heights, according to the plat thereof, as recorded in
Plat Book 43, Page 37, of the Public Records of Miami-Dade County, Florida.
Section 3. Severability. If any section clause, sentence, or phrase of this resolution is
for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding
shall not affect the validity of the remaining portions of this resolution.
Section 4. Effective Date. This resolution shall become effective immediately upon
. adoption by vote of the City Commission.

Resolution approving a plat to allow for the Subdivision of the property

BACKGROUND:
In November 2013, Fifty-Nine Investments, LLC submitted an application to the City for
preliminary review of a tentative plat that was being filed with Miami-Da~e County. A tentative
plat application No. T-23428-2-COR was also filed with Miami Dade County, pursuant to
Section 28-4 of Miami Dade County Code and Section 20-4.2 of the City's Land Development
Code. The applicant owns the property specifically located at 5980 SW 8I st Street (Figure 1),
within an RS-3 single-family residential zoning district and is requesting this replat in order
divide the property into two buildable residential lots. The applicant proposed to demolish the
existing one-story residence on the site prior to final development approval (Figure 3).

Paez, P.S.M., Professional Surveyor and Mapper for Delta Mapping and Surveying, Inc.,

The final plat as proposed meets the minimum requirements for the RS-3 single-family residential zoning
district. The City's arborist will provide a comprehensive review of the proposed tree disposition once the
proposed development and landscape plans have been submitted to the department for Board review, and
prior to the issuance of a development permit. All tree relocation and removal shall be done in compliance
with the City's pennitting and canopy mitigation requirements. Staff recommends approval of the final
plat request with the condition that the applicant comply with the following conditions, and/or other
conditions deemed appropriate by the City Commission.
I. Compliance with the conditions of the Miami-Dade County approval of application No.
T -23428-2-COR;
2. Compliance with current City Land Development Code requirements.
