Res No 043-14-14137RESOLUTION NO. 43-14-14137 A Resolution authorizing the City Manager to pay the Miami Herald for Election Advertisements. WHEREAS, the City of South Miami is required by City Charter and by Florida Statutes to advertise the time and place of the second reading of ordinances and of the first readings of certain resolutions, including resolutions that approve voter referenda; and WHEREAS, during City elections, the City not only is required to advertise public hearing items, but election notices as well; and WHEREAS, the City has duly advertised the 2014 City election ads both in English and Spanish; and WHEREAS, the City has advertised Spanish translations as required by the Voting Rights Act, Sec. 203(C); and WHEREAS, the City has advertised the English verSIOn of election notices in the Neighbors and the Spanish version of election notices in EI Nuevo; and WHEREAS, the City has budgeted an appropriation for the payment of these advertisements under line item "Legal Ads" in Account #001-1200-512-4910; and WHEREAS, Account # 001-1200-512-4910 has a current balance of$22,789.61and WHEREAS, the Mayor and City Commissioners desire to pay the Miami Herald an amount not to exceed $19,215. NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSIONERS OF THE CITY OF SOUTH MIAMI, FLORIDA: Section 1. The City Manager is hereby authorized to pay the Miami Herald an amount not to exceed $19,215 for duly required advertisement to be paid from Account # 001-1200-512- 4910 which has a current balance of$22,789.61. Section 2. Severability. If any section clause, sentence, or phrase of this resolution is for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect the validity of the remaining portions of this resolution. Section 3. Effective Date. This resolution shall become effective immediately upon adoption by vote of the City Commission. PASSED AND ADOPTED this 18thday of March ,2014. Page 10f2 Res.
