A Resolution of the City of South Miami concerning the approval of a waiver of plat

WHEREAS, The Planning Board Application No. PB-14-001 submitted by Mario
Fernandez & Vanessa Turner-Fernandez requesting approval of a Waiver of Plat pursuant Section
20-4.2(b) of the Land Subdivision Regulations in order to divide one existing lot legally
described as the east 129.22 feet of the following described real property situate, lying and being
in Miami-Dade County, Florida; the south 12 of the north 12 of the east 1;2 of the SE Yt of the SE
Yt of the NE Yt, of section 26, township 54 south, range 40 east, lying and being in Miami-Dade
County, Florida. less the east 35 feet thereof; and the south 12 of the north 12 of the east 12 of the
SE Yt of the SE Yt of the NE Yt of section 26, township 54 south, range 40 east, lying and being
in Miami-Dade County, Florida. less the east 35 feet thereof, less and except the east 129.22 feet

WHEREAS, the purpose of the waiver of plat application PB-14-00 1 is to divide the
existing lot totaling 48,787 square feet of lot area, into two lots to construct a new single family
home on one lot while maintaining the existing single family home an tennis court; and
WHEREAS, Planning Department reviewed the application for said waiver of plat for 2-
lots, as it relates to the criteria set forth in the Land Development Code; and
WHEREAS, the proposal for 2-lots is in keeping with the character of the neighborhood
and exceeds the minimum requirements for the RS-3, low density residential zoning district and
Section 20-4.2(B)(2); and
WHEREAS, the Planning Board at its January 14,2014 meeting, and following a public hearing
adopted a motion by a vote of 5 ayes and 0 nays recommending approval of the waiver of plat
application PB-14-00 1 creating two conforming buildable lots.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA THAT:
Section 1. The submittal provided by Mario Fernandez & Vanessa Turner-Fernandez
requesting approval of a Waiver of Plat pursuant Section 20-4.2(B) of the Land Subdivision
Regulations in order to divide an existing single family lot legally described as the east 129.22
feet of the following described real property situate, lying and being in Miami-Dade County,
Florida; the south 12 of the north 1;2 of the east 12 of the SE Yt of the SE Yt of the NE Yt, of
section 26, township 54 south, range 40 east, lying and being in Miami-Dade County, Florida.
less the east 35 feet thereof; and the south 12 of the north Y2 of the east 12 of the SE Yt of the SE Yt

A Resolution of the City of South Miami concerning the approval of a waiver of plat

BACKGROUND:
On December 12th, 2013, an application for Waiver of Plat was filed by the owner of the
property, Mario Fernandez & Vanessa Turner-Fernandez, in order to divide one existing single
family residential parcel located at 6250 SW 67 A venue into two single family lots as described
below. The property currently has a one story single family residence fronting SW 67 Avenue
and a telmis court to the rear of the structure. The applicant intends to split the lot at the rear of
the existing structure and maintain the existing home. The existing tennis court will remain and
be a part of the newly created lot fronting SW 67 Court, where the applicant intends to construct
a new one story single-family residence. The Planning Board at its January 14, 2014 meeting,
and following a public hearing adopted a motion by a vote of 5 ayes and 0 nays recommending
approval of the waiver of plat application PB-14-001 creating two conforming buildable lots

ANALYSIS:
The proposed waiver of plat is intended to create two single residential properties (parcels "A"
and "B"), zoned RS-3 "Low Density Residential," located at 6250 SW 67 Avenue. The two
parcels at this location are consistent with the RS-3 "Low Density Residential" zoning on the
north, south, east and west.

The minimum lot size within the RS-3 zoning use district is 10,000 square feet. The proposed
wavier of plat would create lots that are 21,738 square feet and 28,556 square feet respectively.
Pursuant to Section 20-4.2 of the City's Land Development Code (LDC), subdivision of land is
governed by Chapter 28 of the Miami-Dade County Code of Ordinances. However, waivers of
plat are subject to the provisions of the City's LDC, including Section 20-4.2(B)(2)(a) of the
City's Land Development Regulations, which states in part:
(2) City Commission Findings. Prior to approving a waiver-ofplat, the city
commission shall use the following guidelines:
(a) The building site created by the proposed waiver-ofplat will be equal to or
larger than the majority of the existing building sites and of the same
character as the surrounding area (this shall be demonstrated using copies
of the official plat maps for the subject property and surrounding
neighborhood). (2)
(b) The building site created by the proposed waiver-ofplat will not result in
existing structures becoming nonconforming as they relate to setbacks and other
applicable regulations of these land development regulations.
(c) The building site created by the proposed waiver-ofplat will be free of
encroachments from abutting buildable sites.
The resulting "new" lots will be of similar character as the sunounding properties and will be
larger than the majority of the existing building sites in the surrounding neighborhood (Figure 1).
The existing one-story home fronting SW 67 Avenue will remain on Parcel "A" and will
conform to the all required setback back and dimensional requirements for the RS-3 zoning
district.
The existing tennis court will remain on Parcel "B" and conforms to the setback and dimensional
requirements for the RS-3 zoning district. The applicant intends to construct a new one-story
single family residence that will front SW 67 Court on Parcel "B", once the necessary approvals
have been received.

1. New driveways are not to be constructed within 5 feet of an interior side propeliy line
and a within 15 feet from the property line (right of way line) at comer lots.
2. New connections to water and sewer unless otherwise stipulated by Miami-Dade. For
information on the location of the lines contact Miami Dade WASD.
3. All planning and zoning requirements will be address separately.
4. Final site plan/driveways, and water and sewer plans to be submitted South Miami PW
Engineering Division for approval.
City Arborist Review
The tree removal permit and tree schedule submitted with the application indicates 23 trees
scheduled for removal from Parcel liB II only. No trees are noted for removal on Parcel "A".
Based on the initial review by the city's arborist, the following notations have been made.

One specimen Oak in the foot print; this tree would require 4 12' native Hardwoods;
One specimen Royal Poinciana in the foot print this would require 4 12' native hardwoods;
One Jacaranda Mist folia with a canopy of 500 hundred square feet 1 12' Native hardwood
replacement;
Four Mangos semi poor condition 1 replacement for each with a 12' native hardwood;
A cluster of four Poinciana's however since they are so close together they will never achieve
specimen status; 4 12' replacements required for canopy loss;
Four Sable Palms on site that we recommend for relocation. Ifrelocation is not possible, then
mitigation will be required;
One Fan Palm that needs to be relocated or mitigated; and
One Chinese Tallow tree in poor condition no replacement required.
This would bring the preliminary mitigation requirements to 17 (12 foot) native hardwood
replacements, the relocation of 5 Palms, the removal 1 poor condition tallow, as well 9 invasive
trees listed on site plan that do not require mitigation. The department will continue to work with
the applicant and the landscape architect as the project moves forward.

Thank: you for taking the time to review our documentation. We have decided to
pursue the replatting of our residential property located at 6250 SW 67 AVENUE
SOUTH MIAMI, FL 33143. We intend to divide the property into two single
family lots and construct our family home on the new vacant lot. We have obtained
an updated survey reflecting the new addition of the tennis court, location of
utilities, trees, water, septic system, and our desired boundary line.
We have a preliminary design for the new construction and have hired a local
architect, Carlos R. Dominguez, RA, Coral Gables, FL, whom we have worked
closely with in the past. The contractor for the project will be Eduardo C. Miranda,
GC, 13200 SW 128 ST, STE B2, Miami, FL 33186.
Included in this packet are the required surveys, our planning board public hearing
application, processing fee, 3 sets of addressed mailing labels, proposed site plan,
site drawings, architectural renderings for new construction, and our application

Notice is hereby given that the Miami-Dade County
Public Works and Waste Management Department
(PWWM) will conduct a Community Meeting regarding
the subject project on Wednesday, February 19,2014,
from 6:30 p.m. to 8:00 p.m., at the Robert Russa
Moton Elementary School Auditorium, located at
18050 Homestead Avenue.
This Community Meeting will be conducted to provide
area residents and businesses with information related
to the construction phase of the project The project
consists of reconstructing the existing roadway to include
a raised landscaped median, bicycle facilities, sidewalks,
curb and gutter, a continuous storm drainage system,
two traffic circles, signalization, pavement markings and
signage, and roadway lighting.
Funding for this project will be provided by the Charter
County Transportation Surtax levied pursuant to Section
29.121 of the Code of Miami-Dade County. This project
was specifically listed in the People's Transportation
Plan as one of the Board-requested major roadway
improvement projects.
The construction plans, maps, drawings and other
pertinent information developed by PWWM will be
available for public review at the meeting site from 6:30
pm until 8:00 pm the day of the meeting. The first part
of the Community Meeting provides an opportunity for
attendees to view the construction plans and to discuss
the project with PWWM staff. During the second part,
which is expected to begin at 7:00 pm, there will be a
brief presentation of the project, followed by a question
and answer period for the remainder of the meeting.
It is the policy of Miami-Dade County to comply with all
of the requirements of the Americans with Disabilities Act
(ADA) of 1990. The meeting facility is ADA accessible.

devices or materials in accessible format, please call
