RESOLUTION NO. 217 -13- 14035 A Resolution waiving $3,525 for 64 parking meters and street closure fee, and authorizing the City Manager to permit Chamber South to hold its 42 Annual South Miami Art Festival on November 2 & 3, 2013, in downtown South Miami on Sunset Drive from US I to Red Road. WHEREAS, Chamber South, has submitted a Special Event Application to hold its 42 Annual Arts Festival on November 2 & 3, 2013, on Sunset Drive; and, WHEREAS, for 41 years Chamber South has held their Art Festival in the City of South Miami. This festival showcases approximately 130 artists from around the nation. This venue generates approximately 50,000 attendees who stimulate South Miami's economy through various purchases during this event from local merchants and restaurants; and, WHEREAS, the applicant has paid $500 deposit, $100 administrative fee, $60 application fee, and $400 street and pole banner fee, totaling $1,060.00; and, WHEREAS, Chamber South is requesting a waiver for the cost of 59 parking meters located on Sunset Drive and five (5) meters located behind Chase Bank, City parking lot; in the amount of $3,200 ($1,600 X 2) ($25.00 X 64 total parking meters); and, WHEREAS, the applicant is also requesting a waiver for the street closure fee in the amount of $325.00; and, WHEREAS, the applicant will pay for the following services: Police ($7,730), Public Works ($5,984.11), totaling $13,714.11: and, WHEREAS, Chamber South has requested an extension on the payment of these services to allow time to receive grant funding for this event, which typically takes approximately six to seven (6 - 7 ) months from the date of the event; and WHEREAS, October 2012, under Resolution #202 -12- 13759, the City approved a requested waiver of fees in the amount of $3,200 for 59 parking meters located on Sunset Drive and five (5) meters located behind Chase Bank. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA: Section I. The City Manager is hereby authorized to permit Chamber South to hold the 42 Annual South Miami Art Festival on November 2 & 3, 2013, in downtown South Miami on Sunset Drive from US I to Red Road. Section 2. The City Manager is hereby authorized to allow payment on the final billing in the approximate amount of $7,730 for Police services, and $5,984.11 for Public Pg. 2 of Res. No. 217 -13 -14035 Works totaling $13,714.11 and allowing time to receive grant funding to pay for this event for up to 6 -7 months following completion of the event without interest. Section 3. The City Manager is hereby authorized to waive the parking fees in the amount of $3,200, and street closure fee in the amount of $325. Section 4. If any section clause, sentence, or phrase of this resolution is for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect the validity of the remaining portions of this resolution. The applicant has paid for the $500 deposit, $100 administrative fee, $60 application fee, $400 for street and pole banner fee, totaling $1,060.00. The applicant will pay for the following services: Police ($7,730), Public Works ($5,984.11), totaling $13,714.11. WHEREAS, Chamber South, a non -profit organization, has submitted a Special Event Application to hold its 41" Annual Arts Festival on November 3 & 4, 2012, on Sunset Drive; and, WHEREAS, for the past 40 years Chamber South has held their Art Festival in the City of South Miami. This festival showcases approximately 130 artists from around the nation. This venue generates approximately .50,000 attendees who stimulate South Miami's economy through various purchases during this event from local merchants and restaurants; and, WHEREAS, to continue to have a successful event that not only draws a large attendance, and showcases the City, Chamber South is requesting a waiver for the cost of 59 parking meters located on Sunset Drive and five (5) meters located ' behind Chase Bank; City parking lot in the amount of $3,200 ($1,600 X 2); and, WHEREAS, the applicant has paid for the deposit ($600), application fee ($60.00), street and pole banner fee ($400.00), totaling $1,060.00; and, WHEREAS, the applicant will pay for the following services: Police ($7,730.00), Public Works ($6,376.11), road closure ($325.00), parking 'fees $3,200 (requesting waiver), totaling $17,631.11.
