ORDINANCE OF CITY OF SOUTH MIAMI, FLORIDA,
AMENDING CODE OF ORDINANCES OF CITY OF
SOUTH MIAMI, FLORIDA, BY ADDING THERETO
A SECTION TO BE DESIGNATED SECTION 2 -9
THEREBY CREATING OFFICE OF PUBLIC DEFENDER';
SETTING FORTH MANNER OF APPOINTMENT, DUTIES,
COMPENSATION; PROVIDING FOR EFFECTIVE DATE
AND SEVERABILITY.
IT_ORDAINED BY THE MAYOR AND CITY COUNCIL OF CITY
OF SOUTH MIAMI, FLORIDA:

1. The Code of Ordi`naices of City of South Miami,
Florida, is hereby amended by adding thereto a section to

be designated Section 2 -9. Said Section 2 -9 to read as
follows:
Section 2 -9. PUBLIC DEFENDER. The office of
public defender shall be under the supervision

Mayor, subject to the approval of the Council.
The public 'defender shall serve fora term
of one year commencing 'on March 15 of each
year, an interim appointment shall be made
until the commencement of the next term.
The'publ`ic defender shall represent -any ndi'geiit
person-"under arrest by the Clly' police -or cha'r'ged
with an offense in the municipal court if such
person requests it or the court so orders it.
The public de "fender may, with the consent of the
municipal court, accept the volunta "r "y services
of members -of the Florida: Bar but without'compen-
sation by the City.
`- Any individual seeking the defender's services
shall submit an affidavit of his financial
circumstances. The municipal court shall deter-
mine eligibility and may make such determination
s at any stage of the proceedings: In the ev`'n..

;.{ financially able to obtain independent counsel
of his choice, "the public defender shall withdraw
from active representation.
The public defender shall draw no salary but will
be compensated for necessary expenses.
2. This ordinance shall become effective upon its
adoption.
