Res No 177-13-13995RESOLUTION NO. 177-13-13995 A Resolution related to a request pursuant to Section 20- 3.5(D) of the South Miami Land Development Code, requesting an additional (third) floor within the Madison Square Mixed Use Development Project, located between SW 60 Avenue and SW 59 Court; and between SW 64 Street and SW 66 Street. WHEREAS, at the December 18, 2012 Commission meeting, Ordinance #31 -12 -2147 was approved, modifying the zoning district for the subject area from a combination of Neighborhood Retail (NR) and Small Lot Single Family Residential (RS -4) to Specialty Retail (SR) to facilitate the mixed -use development project known as Madison Square; and WHEREAS, the Specialty Retail (SR) zoning district allows mixed use projects up to 4- stories in height; and WHEREAS, because the proposed project area abuts single family zoning districts on the North, West and South, any proposed zoning designation greater than 2- stories that is applied to this project must adhere to the regulations listed in Section 20- 3.5(D)(1) of the Land Development Code; and WHEREAS, Section 20- 3.5(D)(1) stipulates that additional project height may be obtained via the special use permit process as set forth in Section 20 -5.8, the pertinent parts of which are as follows: 20 -5.8 Special use approvals. (B)Required Conditions. (1) Prior to approving a special use, the city commission shall find ... that it: (a) Will not adversely affect the health or safety of persons residing or working in the vicinity of the proposed use; (b) Will not be detrimental to the public welfare or property or improvements in the neighborhood; and (c) Complies with all other applicable Code provisions. (2) Additional Conditions. The city commission may designate such additional conditions in connection with a special use as will, in its opinion, assure that such use will conform to the foregoing requirements. WHEREAS, at their June 10, 2013 meeting, the South Miami Community Redevelopment Agency (SMCRA) Board voted submit an application to the Planning Board and City Commission under the provisions of Section 20- 3.5(D)(1), to allow for 3 -story building heights as part of the Madison Square development project; and WHEREAS, the special use review process requires a recommendation from the Planning Board and the approval of the City Commission after a public hearing; and WHEREAS, at the August 13, 2013 regular meeting, the Planning Board following a public hearing, voted to recommend approval application PB -13 -026 by a vote of 5 ayes, 0 nays; with the condition that the third story be limited to the structures along SW 64th Street; and NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA THAT: Res. BACKGROUND The applicant, South Miami Community Redevelopment Agency (SMCRA), is requesting approval via the special use review process to increase the height of the Madison Square Mixed Use Development Project from two (2) stories to a maximum height of three (3) stories for properties located between SW 60`' Avenue and SW 591h Court; and between SW 64th Street and SW 66th Street. APPLICABLE REGULATIONS At the December 18, 2012 Commission meeting, Ordinance #31 -12 -2147 was approved, modifying the zoning district for the subject area from a combination of Neighborhood Retail (NR) and Small Lot Single Family Residential (RS -4) to Specialty Retail (SR). By changing the zoning district to SR, it allowed for the development of a mixed use, residential /commercial project. Under the previous zoning designation of NR, residential uses were not permitted except as a Planned Unit Development. The amendment also allowed the development to increase its height up to 4- stories. However, because the proposed project area abuts single family zoning districts on the North, West and South, any proposed zoning designation greater than 2- stories that is applied to this project must adhere to the regulations listed in Section 20- 3.5(D)(1) of the Land Development Code: Properties Abutting, Single- Family Zoning Districts. Notwithstanding the dimensional requirements of the zoning use district in which a property is located if that property is abutting (common border or separated by a right - of -way) to a single family zoning district the maximum height of any new building or any vertical addition to an existing building on that property is limited to two stories, however, additional height may be obtained via the special use permit process as set ,forth in Section 20 -5.8. Under the regulations of the special use process that are listed under Section 20 -5.8 of the Land Development Code, approval may be granted after two (2) public hearings. The first public hearing shall be before the planning board, at which time the planning board will review the project and provide to the city commission an advisory recommendation regarding approval, approval with conditions, or disapproval. At the second public hearing, the city commission will determine the overall compatibility of the additional height with the surrounding neighborhood. This motion is enumerated below and in the attached email correspondence dated June 13, 2013. SMCRA Board Approved Motion #1- "Authorization for the SMCRA to submit a request for special exception to the City of South Miami Planning & Zoning Board to allow for 3 -story building heights as part of the Madison Square development project as proposed by project developer in all project areas adjacent to residential uses ". Figure I • The properties that comprise the Madison Square development project can be found on the attached chart entitled Special Exception Application Property Folio List. • The mix of land uses is compatible with the proposed additional (3rd) story. • The location of the development along several street frontages, including SW 64th Street provides a natural buffer for the additional floor being requested. • The developer has indicated in the attached rendering that the proposal will step down to a 2 -story height in those areas of the project closest to existing single family residential. The applicant is requesting a height increase of one story, bringing the maximum stories for the project to three (3). This increase would not exceed the maximum height allowed in the Specialty Retail (SR) zoning district, which is four (4) stories. SPECIAL USE REVIEW 1. The overall purpose of going through the special use review process is to determine the compatibility of the proposed use with the surrounding neighborhood. A special use must comply with the conditions set forth in Section 20- 5.8(B) in that the use: a) Will not adversely affect the health or safety of persons residing or working in the vicinity of the proposed use; b) Will not be detrimental to the public welfare or property or improvements in the neighborhood; and, c) Complies with all other applicable Code provisions. RECOMMENDATION The Planning Board at the August 13, 2013 meeting, following a public hearing on application PB -13- 026, made a motion to approve the third floor request for the Madison Square mixed use development project with the condition that the additional height be limited to the structures along SW 64th Street. This motion was approved by a vote of 5 ayes, and 0 nays. He stated next that what became apparent was that there were conflicting and various ideas as to the development of this property. He then stated that some groups expressed the desire for greater density, others were of the opinion to higher than four stories and no less, and others shared a concern for a limited height adjacent to single family homes. He stated that they tried to comply with the many requests and find the right balance. Mr. Vitalini gave a brief presentation of the project to the Board. Mr. Sol stated that one apartment building and two small houses will be demoed in the area in order to implement this project. Mr. Vitalini stated that it is important to note that retail will be located along sixty - Fourth Street which was one of the requests that was largely expressed by everyone. Mr. Sol stated that what they are proposing will consist of one bedroom units, two bedroom units, and three bedroom units built with a total of forty -one units. Mr. Sol stated that this formula is used by the State of Florida and Miami -Dade County Housing and Urban Development (HUD) based on the annual incomes of the families. Mr. James McCants, the CRA Outreach Coordinator stated that there are a total of eight displaced families that will be relocated with the aid of the CRA. He also stated that they will be given first priority in choosing to move back once this project is complete. Mr. Sol stated that the commercial retail that will be located on the first floor will be geared to promote jobs within the CRA area and encourage the residents to shop and receive services within the neighborhood opposed to travelling a number of miles away.
