Res No 194-10-13228RESOLUTION NO. 194-10-13228 A Resolution of the Mayor and City Commission of the City of South Miami, Florida, retaining Hector Mirabile, Ph.D. as the City's new City Manager under terms set forth in this Resolution which terms shall remain in effect through September 21, 2010, and directing the Deputy City Attorney and City Manager to return to the City Commission on September 21, 2010, with an employment agreement for the new City Manager for the Commission's consideration; providing an effective date. WHEREAS, pursuant to Article II, Section 7 of the City of South Miami Charter the Mayor and City Commission is vested with the power to appoint a City Manager; and, WHEREAS, the City Commission has conducted a nation -wide search for a City Manager and has received sixty -nine (69) applications, has screened the applications with the assistance of the Mercer Group and has interviewed seven (7) finalists for the position of City Manager; and WHEREAS, the City of South Miami wish to employ Dr. Mirabile's services as City Manager of the City of South Miami and desires to immediately employ him with a contract to be presented to the City Commission on September 21, 2010. Now therefore be it resolved by the Mayor and City commission of the City of South Miami, Florida, that: Section 1. Hector Mirabile, Ph.D. is hereby retained as the City's new City Manager. He shall receive an annual salary of $140,000 payable in bi- weekly increments. Additionally, he shall be entitled to the following benefits through September 21, 2010: Vacation at a rate of 2.33 days per month. Sick leave at eight hours per month. Retirement contribution to a 401A account in an amount equal to eleven percent of the then City Manager's base salary. Car allowance $650 per month. City issued and paid for cellular telephone. Indemnity - if the City Manager is named in litigation resulting from responsible conduct of duties as directed by the Commission, and the City Manager leaves the City's employment, the City Manager's legal expenses will be covered by the City. A life insurance policy equivalent to one years salary. Health insurance reimbursement payment of $680 per month. Section 2. The Deputy City Attorney and City Manager shall return to the City Commission on September 21, 2010, with an employment agreement for the new City Manager for the Commission's consideration.
