No. 08-08-1943ORDINANCE NO. 08 -08 -1 943 AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA, RELATING TO A REQUEST TO AMEND THE OFFICIAL ZONING MAP OF THE CITY OF SOUTH MIAMI LAND DEVELOPMENT CODE BY DESIGNATING A SINGLE FAMILY RESIDENTIAL BUILDING LOCATED AT 5730 SW 49" STREET AS AN HISTORIC SITE AND BY PLACEMENT OF AN HISTORIC PRESERVATION OVERLAY ZONE (HP -OV) OVER THE EXISTING ZONING USE DISTRICT FOR THIS PROPERTY; PROVIDING FOR SEVERABILITY; PROVIDING FOR ORDINANCES IN CONFLICT; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, Application No. PB -08 -005 was submitted to the Planning Department by the Historic Preservation Board , said application requesting to amend the official zoning map of the City of South Miami by overlaying an "HP -OV" Historic Preservation Overlay zoning district for property located at 5730 SW 49th Street; and WHEREAS, the Historic Preservation Board at its December 26, 2008 meeting reviewed a Designation Report for 5730 SW 49t" Street and voted 5 ayes 0 nays to recommend that the proposed site be designated historic; and WHEREAS, the proposed historic designation and rezoning is consistent with the goals and policies and the future Land Use Map of the City of South Miami Comprehensive Plan; and WHEREAS, the Planning Board, at its January 31, 2008 meeting, after a public hearing regarding the application of the HP -OV zoning to 4000 SW 57th Avenue, recommended by a vote of 6 ayes and 0 nays that the designation be approved; and WHEREAS, the City Commission desires to accept the recommendation of the Historic Preservation Board and the Planning Board and enact the aforesaid HP -OV zoning. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND THE CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA: Section 1. That the City's Official Zoning Map shall be amended by placing the Historic Preservation Overlay (HP -OV) zoning district over the existing underlying zoning use district for property identified as the 5730 SW 49`h Street as shown and legally described in the attached Designation Report. Section 2. That the Designation Report for the building at 5730 SW 49l' Street, as prepared by the South Miami Planning Department is identified as Attachment "A" and is attached to and made part of this ordinance. Section 3 The Design Review Guidelines set forth in the attached Designation Report and the criteria in the Land Development Code pertaining to the issuance of a certificate of appropriateness will be used if a building permit affecting the exterior of the structure is ever requested for the designated property at 5730 SW 49a' Street. If any section, clause, sentence, or phrase of this ordinance is for any reason held invalid or unconstitutional by a court of competent jurisdiction, this holding shall not affect the validity of the remaining portions of this ordinance. Section 5 All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 6. This ordinance shall be effective immediately after the adoption hereof. Following a public hearing, the Board adopted a motion by a vote of 5 ayes 0 nays recommending that this building be designated an historic site. The Land Development Code provides that an historic designation recommendation must be enacted as a zone map change. The "HP -OV" Historic Preservation Overlay zoning district is superimposed as an overlay over the existing underlying use zone. The procedures in the land development code (LDC) require the Planning Board to hold a public hearing on all designations recommended by the Historic Preservation Board. (Section 20- 5.17(E)) Historic Significance- 5730 SW 491h Street The designation of an historic site requires that the Historic Preservation Board approve a Designation Report which sets forth the history of the building and the architectural significance. Attached to this staff report is the Designation Report which was approved by the Historic Board after a public hearing at its December 26, 2007 meeting. The report contains a detailed history of the site and includes photographs of the building. The designation of the building is based upon it being a classic example of Spanish Mediterranean Revival architecture. The attached designation report describes in detail the architectural character of this building (p. 7).The Designation Report contains a section (pp. 9 -10) entitled Design Review Guidelines which establishes architectural guidelines for the review of future certificates of appropriateness. (2) Historic Preservation Board Action The Historic Preservation Board at its December 26, 2007 meeting adopted a )!notion by a vote of 5 ayes 0 nays recommending that the historic designation be approved. Planning Board Action The Planning Board at its January 31, 2008 adopted a motion by a vote of 6 ayes 0 nays recommending that the historic designation be approved. Recommendation It is important to note that the property owner has not objected to the proposed designation. SIGNIFICANCE Specific Dates: 1927 Architect: Unknown Subdivision Developers: Original Plat: John and Louis Nein (1925) Resubdivision: David and Emily Harlan (1935) Statement of Significance The design for this residence reflects the quintessential "Spanish - Mediterranean" characteristics that were the overwhelming choice of developers who sought to create a pedigree for the newly developed landscape in the South Florida region. The original plat for the "Biltmore Heights" subdivision was recorded on September 30, 1925, almost exactly one year before the devastating hurricane of September 17 -18, 1926 would begin a series of unfortunate events that ended the unprecedented Florida Real Estate Boom. While some houses were completed in the Biltmore Heights subdivision, including the home at 5730 SW 49th Street, the subdivision remained primarily undeveloped until its 1935 replatting. The residence at 5730 SW 49th Street is significant for its architectural design, and as it reflects the turbulent period of the boom and bust cycles in South Miami. Contextual History During the late 1880s, South Miami was little more than a pioneer enclave of settlers who established homesteads in the area. When Henry Flagler's Florida East Coast Railway built an extension from Miami to Homestead in 1904, with the Town of Larkins as a stop along the way, the community was poised for its development. By 1917, the population of the town had reached approximately 350. By July 1918 nine plats were filed, four of them east of the railroad and five of them to the west. Much of the land remained in agricultural use. Visitors to Larkins were directed to follow "the black road ", which referred to the newly oiled Ingraham Highway, that extended from Miami to Homestead by way of Coconut Grove's bay front and along the ridge to what was later Sunset Drive, and then west to the railroad at Larkins. At that time, South Miami's immediate neighbor to the east was Coral Gables. The first lots in Coral Gables were sold in 1921, and under the leadership of its founder George E. Merrick, continued to expand as more and more land was acquired. Eventually, even the Larkin's Homestead Local Historic Designation Report 5730 SW 494h Street Page 4 was sold to Coral Gables, and the development of South Miami moved west. During the 1920s all of South Florida was caught up in the frenetic activity of the Florida Land Boom. South Miami was no exception. During these flamboyant times there were several buildings of consequence constructed in South Miami including the Methodist Church and the Riviera Theater (demolished.) Residential subdivisions were platted as thousands purchased homes in the area. In March 1926, sixty -nine qualified voters within the proposed corporate limits met to change the name of their town from Larkins to the City of South Miami. At that time the boundaries, which covered approximately six square miles, were: Red Road on the east; Ludlum and Palmetto Road on the west; Bird Road and Miller Road on the north, and SW 104th Street and North Kendall Drive on the south. Already failing in 1926, by 1927, the real estate boom had abruptly ended, and the state of Florida entered into an economic depression even before the rest of the nation, when the stock market collapsed in 1929. While growth would return, the 1930s saw a precipitous slowdown in the market. In 1933 the City's population increased to 1,500 residents, but the corporate limits of the city were reduced to an area of approximately four square miles. The burgeoning growth of the 1920s was experienced again following World War II, when tens of thousands of returning GIs made the area their home. A TALE OF TWO CITIES The relationship between the Town of Larkins and the City of Coral Gables was very close during the early 1920s. George Merrick, the founder and developer of the City of Coral Gables, began the sale of lots in] 921 and was continually expanding his holdings that would eventually reach to over 1,600-acres by 1 9241. George Merrick was continuing the development of Coral Gables, and platted the Riviera Section, directly adjacent to-the Town of Larkins on the west (separated by Red Road (SW 57th Avenue) in October, 1925.2. One of his acquisitions was four of the five acres of land owned by The Coco Plum Woman's Club's. Mrs. Mary B. Dorn was the first president of the club which was founded by pioneering Larkin women in 1913 as the "Coco Plum Thimble Club ", and later in 1916 changed their name to the Woman's Club of Larkin ".3 Mrs. Dorn had scouted out the land on 1 Millas, Aristides and Ellen J. "The Cocoplum Woman's Club" National Register Nomination Local Historic Designation Report 5730 SW 49th Street Page 5 which their clubhouse would be built, then owned by the "Model Land Company ", a subsidiary of Henry Flagler's Florida East Coast Railway. When Merrick platted the Riviera Section, he particularly desired the club's land, and after negotiation, the club sold four of its five acres to the Coral Gables Corporation for the sum of $100,000.4 The plat for Biltmore Heights was approved on September 30, 1925. Given its proximity to Coral Gables, it is not surprising that the Nein Brothers (who filed the plat), would emulate the theme of Merrick's development. They named the streets, capitalizing on the romantic Spanish ideals that were being used to sell Coral Gables. SW 49th Street was originally named "Pinta Avenue ", SW 50th Street was named "Nina Avenue ",. SW 50th Terrace as " Santa Maria ", and SW 51St Street as "Santa Fe Avenue ". The westernmost street of Biltmore Heights was Ludlum Road, which in the original development was given the name "Badalonia ". When the boom ended, the Coral Gables Corporation was some $29 million in debt, and foreclosures were commonplace. New subdivisions were in the same situation, and construction in the Biltmore Heights Subdivision ended abruptly. III. ARCHITECTURAL DISTINCTION The style of this two story rectangular building is best described as Mediterranean Revival, an eclectic design based on prototypes from Spanish, Italian and Moorish architectural archetypes. The design was hugely popular during the 1920s real estate boom, and came to characterize the region. The designs often featured irregular plans, courtyards, flat roofs with distinctive parapets or combinations of roof slopes in residential construction, and ornament concentrated around doors and windows. The residence at 5730 SW 49th Street, expresses the hallmarks of the Mediterranean Revival style in its: ® masonry construction, ® combination of one and two story sections ® combination of gabled and shed roofs ® prominent front porch that features an arcade of round arches ® use of a clay file as the roofing material, and the coping that follows the roof ridges ® prominent chimney with a decorative brick chimney cap ® double -hung sash windows with a projecting sill beneath ® separate masonry accessory building ( originally intended as a garage) Alterations: Throughout its long history, the residence has had few changes to its character. Minor alterations include: • anew driveway treatment of concrete pavers (1989) • extension of the concrete slab at the rear of the house ( 1989) • new concrete risers faced with tile ( 1989) • reproofing with an "S" tile (1989) The residence maintains its integrity of design to qualify for local historic designation. ELIGIBILITY FOR DESIGNATION The South Miami Land Development Code; Section 20.4.9 entitled "Historic Preservation Standards" lists the following criteria that a property must meet in order to be considered for local historic designation: (a) Districts, sties, structures and objects of national, state, and local importance are of historic significance if they possess integrity of location, design, setting, materials, workmanship, feeling and association and: (b) Are associated with events that have made a significant contribution of the broad patterns of our history, and (c) Embodies the distinctive characteristics of a type, period, method of construction or work of a master, or that possess high artistic value, or that represent a distinguishable entity whose components may lack individual distinction. The Residence at 5730 SW 49th Street possesses integrity of location, design, setting, materials, workmanship, feeling and association and meets criteria (b) as it reflects the turbulent period of the boom and bust real estate cycles in the region's history; (c) as it represents the distinctive character of a Mediterranean - inspired design, made popular in the South Florida region by a significant number of developments. Therefore, the residence at 5730 SW 49th Street is recommended for local historic designation. V. DESIGN REVIEW GUIDELINES In accordance with the procedures set forth in Section 20.5.19 of the City's Land Development Code, any building permit for exterior alteration, renovation or demolition of an existing structure, which is designated historic, or is within a designated historic district shall first require the issuance of a Certificate of Appropriateness (COA). The COA is issued after review by the Historic Preservation Board and the City Commission. The Historic Preservation Board shall adopt and may, from time to time, amend the standards by which applications for a Certificate of Appropriateness may be evaluated. In adopting these guidelines, it shall be the intent of the Board to promote maintenance, restoration, adaptive uses, appropriate to the property, and compatible contemporary designs that are harmonious with the exterior architectural and landscape features of neighboring buildings, sites, and streetscapes. (2) The designation of historic sites is compatible with several Future Land Use Element goals and objectives contained in the City of South Miami Comprehensive Plan: ® Objective '1.2 Preserve_ historic resources by experiencing no demolition or reconfiguration of suecified resources ........." (3) The alteration, renovation, remodeling, or landscape change affecting the exterior of a designated historic building will require special approval in the form of a "certificate of appropriateness" (COA). This approval requires a review by the Historic Preservation Board and final approval by the City Commission. The Designation Report contains a section entitled Design Review Guidelines (pp. 9 -10) which establishes architectural guidelines for the review of future certificates of appropriateness. (4) The proposed designation will not require changes to any of the dimensional standards or permitted uses currently applicable to the area's underlining "RS -4 ", Single Family zoning district. (5) The City's preservation consultant concluded that the building is eligible for historic designation (p.8). RECOMMENDATION: It is recommended that the historic designation and the placement of an "HP -OV" district over the existing zoning district for the building at 5730 SW 49th Street be approved. Action: Mr. Morton read the item into the record. Mr. Perez advised that at its December 26, 2007 meeting the Historic Preservation Board reviewed an historic designation report for a single family home built in 1927, located at 5730 SW 49 Street. Following a public hearing, the Board adopted a motion by a vote of 5 Planning Board Meeting January 31, 2008 Excerpt Page 2 of 2 ayes 0 nays recommending that this building be designated an historic site. Attached to the staff report was a Designation Report containing historical details which was approved by the HPB after the public hearing. The designation of the building is based upon it being a classic example of Spanish Mediterranean Revival architecture. The attached designation report provided details on the architectural character of this building. The Design Review Guidelines are to be used for reviewing of future certificates of appropriateness. Mr. Perez advised that staff recommended that the historic designation and the placement of an "HP- OW district over the existing zoning district for the building at 5730 SW 49th Street be approved. Mr. Youkilis advised that he homeowner was in favor of the historic designation. Ms. Cheal added that the house, although simple, is very nice. Ms. Young questioned if the accessory structure was being used as a livable quarter. Mr. Youkilis advised that it appeared that the structure was only used for storage. Mr. Perez replied that most site visits only include external surveys. Ms. Beclunan questioned if documentation existed indicating the alterations that have been made. Mr. Youkilis replied that staff has the records dated back to 1960 only. Motion: Ms. Beckman moved to approve the historic designation for the property located on 5730 SW 49 Street. Historic Designations / Public hearing: HPB -07 -009: 5730 SW 49 Street Action: Mr. Youkilis called the Board's attention to the architectural distinction and the eligibility for designation. He stated that the consultant mentions the style of the two story building could best be described as Mediterranean Revival, a design which was popular during the 1920's. The residence expresses the hallmarks of the Mediterranean Revival style in several characteristic. It was found that the residence has had minor alterations. It also possesses integrity of location, design, setting, materials, workmanship, feeling and association thus meeting the eligibility criteria. In general, the residence meets the Secretary of the Interior's Standards for Historic Preservation requirements, therefore staff recorrunends approval for the historic designation of the property located on 5730 SW 49 Street. Mr. Ruiz de Castilla stated he was impressed with the changes which the residence has undergone. He added that the owner has sensitively maintained the home in good character with its neighbors. Mr. Hochstim added that the home has unique architectural quality and questioned if the original architect's name was known. Mr. Youkilis replied there were no records indicating that infonnation however staff will conduct further research. Mr. Youkilis further added that although he did ask the current owner for that information the homeowner was also unaware. The homeowner did however mention that the Value Adjustment Board might have old site plans. Mr. Hochstim noted that he was impressed with the designation repost prepared by the City's consultant Ms. Uguccioni.
