An Ordinance providing City of South Miami approval for the donation of
land requested by the State of Florida Department of Transportation for
transportation related purposes and for road improvements to include a
new bike lane by the conveying approximately 2,496 Square Feet more or
less of swale area along SW 57 Avenue in South Miami, Florida.
WHEREAS, the State of Florida Department of Transportation proposes to construct or
improve State Road No. 959, Item No. 4284841, in Miami -Dade County, Florida; and
WHEREAS, it is necessary that certain lands now owned by the City of South Miami,
Florida, be acquired by the State of Florida Department of Transportation; and
WHEREAS, said property is not needed for City purposes; and
WHEREAS, the State of Florida Department of Transportation has made application to
said City to execute and deliver to the State of Florida Department of Transportation a deed, or
deeds, in favor of the State of Florida Department of Transportation, conveying all rights, title
and interest that said City has in and to said lands required for transportation purposes and said
request having been duly considered; and
WHEREAS, the City Commission of the City of South Miami wishes to convey title to
said lands to the Department of Transportation.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION
OF THE CITY OF SOUTH MIAMI, FLORIDA:
Section 1. The application of the State of Florida Department of Transportation for a
deed, or deeds, is for transportation purposes which are in the public or community interest and
for public welfare and the land needed for transportation purposes is not needed for City
purposes
Section 2. The City Manager is hereby instructed to execute a deed of the City of
South Miami, Florida conveying title to the Florida Department of Transportation.
Section 3. Severability. If any section, clause, sentence, or phrase of this ordinance is
for any reason held invalid or unconstitutional by a court of competent jurisdiction, this holding
shall not affect the validity of the remaining portions of this ordinance.
Section 4. Ordinances in Conflict. All ordinances or parts of ordinances and all
sections and parts of sections of ordinances in direct conflict herewith are hereby repealed.
However, it is not the intent of this section to repeal entire ordinances, or parts of ordinances,
that give the appearance of being in conflict when the two ordinances can be harmonized or
when only a portion of the ordinance in conflict needs to be repealed to harmonize the
ordinances. If the ordinance in conflict can be harmonized by amending its terms, it is hereby
amended to harmonize the two ordinances. Therefore, only that portion that needs to be
repealed to harmonize the two ordinances shall be repealed.

Ordinance: An Ordinance providing for the City of South Miami approving the donation of
land requested by the State of Florida Department of Transportation for
transportation related purposes for road improvements to include a new bike
lane by the conveying approximately 2,496 Square Feet more or less of
swale area along SW 57 Avenue in South Miami, Florida.
Background: FDOT is proposing a miling and resurfacing project along SR 959/SW 57
Avenue (Red Road from SR5 1US1 (S. Dixie Highway to SR 976/SW40 St
(Bird Road in Miami -Dade County. The project is 1.82 miles long. As part of
the milling and resurfacing, additional pavement area is being added to
provide a 5 foot shoulder along the corridor. These shoulders will also be
striped to serve as a bicycle pathway along both sides of the road.
During the due diligence process, FDOT noticed that the City of South Miami
has ownership of a portion of the swale on SW 57 Avenue and SW 68 Street
of approximately 2,496 square feet in size. In order to have clear tile for the
entire roadway and be able to commence the project, FDOT is requesting
that the City of South Miami donate that portion of the swale.

Protect Description.
FDOT is proposing a milling and resurfacing project along SR 959/SW 57 Avenue/Red Road
from SR 5/CJS 1/S Dixie Highway to SR 976/SW 40 Street/Bird Road in Miami -Dade County.
The project is 1.82 miles in length. The adjacent land use is mostly residential with some
commercial use at the intersection with SR 976/SW 40 Street/Bird and mixed commercial,
residential and institutional use from SW 60 Street south to US 1. The posted speed limit along
the project segment varies froze 35 to 40 MPH. The typical section along the project limits
consists of two undivided lanes, left turn lanes at almost all signalized intersections, and
sidewalk on both sides of the roadway. SW 57 Avenue has one northbound and one southbound
travel lane from SW 40 Street to SW 64 Street. South of SW 64 Street, SW 57 Avenue has two
northbound travel lanes, and from SW 66 Street to US 1, there are two southbound travel lanes,
Other existing features include a school zone from SW 46 Terrace to south of SW 42 Terrace
and a bus bay on the west side of the roadway north of SW 64 Street.
SR 959 was designated as a state historic roadway on June 28, 1989 as stated in Senate Bill No.
124. This Bill has been recently modified to allow improvements related to the safety of
vehicular and pedestrian use within the FDOT right of way.
The scope of work for this segment consists of the following:
• Pavement resurfacing and rehabilitation (milling and resurfacing).
• Signing and pavement marking improvements.
Y Restr•iping travel lanes to l.1 feet and adding approximately 2.5 feet of additional pavement to
provide 5' paved shoulder along the corridor. These shoulders will also be striped to serve as a
bicycle facility along both sides of the road.
• Upgrading all pedestrian ramps to be compliant with FDOT and Americans with Disabilities
Act (ADA) requirements.
• Replacing existing span -wire traffic signals with mast -arm installations at the intersection with
SW 56 Sheet.
• Extending the westbound left-turn lane on US 1 for vehicles turning south onto SW 57
Avenue.
• Relocating three paten trees from the median on US I east of the intersection with SW 57
Avenue in order to extend the westbound left -turn ],tile.
• Removing two parking spaces on the west side of SW 57 Avenue just south of the intersection
of SW 40 Street: to improve sight - distance for turning vehicles from S.W. 41 Street.
