Res No 192-11-13506RESOLUTION NO. 192-11-13506 A Resolution relating to a request pursuant to Section 20- 3.4(B)(16) of the Land Development Code for Special Use Approval to locate a barber shop at 5825 SW 68 Street within the "LO" Low - Intensity Office zoning district. WHEREAS, pursuant to Section 20- 3.4(B)(16) of the Land Development Code (LDC), the applicant, Rodney Williams submitted to the Planning Board Application No. PB -11 -028 requesting a Special Use Approval to operate a barber shop to be located on the ground floor of an existing mixed use building at 5825 SW 68 Street within the "LO," Low - Intensity Office Zoning District; and WHEREAS, a barber shop is a professional service which is permitted as a special use in within the "LO," Low - Intensity Office Zoning District; and is subject to meeting general conditions specified in LDC Section 20 -5.8 and subject to meeting special use requirements set forth in LDC Section 20- 3.4(B)(16); and WHEREAS, the South Miami Community Redevelopment Agency on September 19, 2011 by Resolution CRA 48 -11 -518, authorized a startup business grant in order to process the special use approval application; and WHEREAS, the approval of a special use requires a recommendation from the Planning Board and the approval of the City Commission after a public hearing; and WHEREAS, at its October 11, 2011 meeting the Planning Board, after public hearing, unanimously adopted a motion recommending approval of the special use barber shop request. WHEREAS, at its October 11, 2011 meeting, the Planning Board after public hearing, adopted a second motion recommending that the City Commission permit the barber shop to have one additional small identifying sign on the building. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA THAT: Section 1: Special Use Application (PB -I1 -028) submitted by applicant Rodney Williams for approval to operate a barber shop to be located on the ground floor of an existing mixed use building at 5825 SW 68 Street "LO" Low - Intensity Office Zoning district is hereby approved subject to the following conditions: (1) All signage for the new establishment is subject to approval by the Environmental Review & Preservation Board. (2) Any and all exterior renovations or modifications for the new establishment are subject to approval by the Environmental Review & Preservation Board. Res. APPLICANT'S REQUEST Located in the Low - Intensity (LO) zoning district, the applicant is requesting approval to open a barbershop at the above listed property. STAFF ANALYSIS Pursuant to Section 20- 3.3(D) of the Land Development Code (LDC), a barber shop is a permitted use in the LO zoning district via the special use process. Section 20- 3.4(A) of the LDC provides that special uses may be approved by the City Commission via a public hearing following review and recommendation by the Planning Board. Located in the Mobley Building, which is presently owned by the South Miami Community Redevelopment Agency ( SMCRA), the applicant proposes to open a barber shop that would service the local community and the South Miami area. Mr. Williams, the applicant, wishes to open his business in the first bay /section of the building, which is shown as bay 1B on the attached Mobley Building Floor PIan. Section 20- 4.4(B)(11) of the Land Development Code, stipulates that the parking requirement for a beauty/barbershop is one space per 300 square feet of gross floor area; the proposed barbershop with be approximately 150 square feet. Based on this information, one (1) parking space will be required for the proposed use. The attached boundary survey for the Mobley Building indicates approximately 6,405.6 square feet. Using the parking ratio for a professional office use, which is one space per 250 square feet of gross floor area, the SMCRA is required to provide at least twenty -six (26) parking spaces for its tenants. Per the attached site plan there are a total of twenty -three (23) parking on site spaces. The use of three (3) additional on- street parking spaces was approved by the City Commission through Resolution 73- 09- 12882. These three (3) spaces count towards the minimum parking requirement for Mobley Building. Based on the available on -site parking and previous approval granted by the City Commission, the minimum parking requirement for the proposed barbershop will be met. Section 20- 3.4(B)(16) of the LDC provides the following special requirements for a barber shop. (16) ACCESSORY RETAIL AND SERVICE USES Within any permitted principal building in LO or MO districts, accessory retail or service uses may be permitted provided that: (a) Such uses are located entirely within the principal building for the convenience of the occupants of or visitors to the principal use; (b) Such uses do not occupy more than ten (10) percent. of the gross floor area or the principal building in which located,- and (c) Such uses shall not have any signs or advertising visible from outside the principal building. Staff reviewed the application against the regulations listed above and finds that the request is in compliance with these provisions. The only signage that the tenant will have will be the business name on the master signage directory that was previously approved by the Environmental Review & Preservation Board (ERPB). Because of this regulation, the additional signage that was approved by the ERPB (nameplate next to the entrance to the unit to be occupied) will not be permitted for use by the proposed barbershop at this time, unless accompanied by a recommendation for approval by the Planning Board. At the October 11, 2011 Planning Board meeting after a public hearing on Case PB -11- 028, the board voted unanimously to recommend approval of the special use application to the City Commission. The board also addressed the question of an additional nameplate sign next to the entrance of the unit, and voted [6 yes, I no - Beckman] to recommend that the business be allowed the additional sign. SPECIAL CONDITIONS APPLICABLE: The overall purpose of going through the special use process is to determine the compatibility of the proposed use with the surrounding neighborhood. Therefore, a special use must comply with the conditions set forth in Section 20- 5.8(B) in that the use: a) Will not adversely affect the health or safety of persons residing or working in the vicinity of the proposed use; b) Will not be detrimental to the public welfare or property or improvements in the neighborhood; and, c) Complies with all other applicable Code provisions. RECOMMENDATION: Staff recommends that the Commission approve the special use application for a barbershop, located at 5825 SW 68 Street. '111U SMCRA Y,faKnnlem A' i %�'✓n %fin Gr[Mf:m Ntn-G ::Sd2�uiP•ey' July 14, 2011 City of South Miami Plamring Board Members: During the 2009 -2010 Fiscal Year and based on the direction of the South Miami Community Redevelopment Agency (SMCRA) Board, the Agency established a start -up business and not - for - profit community service office initiative, The intent of the Start -Up Business and Community Service Program is to encourage and promote eligible businesses and community service providers in the Redevelopment Area. The Redevelopment Area was originally established based on an adopted Findings of Necessity Report identifying a dramatic need in the Community Redevelopment Ai-ea for social, economic and structural improvement. The program is currontir housed in the newly constructed SMCRA owned Mobley Building Iodated at 5825 SW 68" Street, South Miami, Florida 33143 (See Exhibit A). The Mobley Building is approximately 6,100 square feet in area and is divided into thirteen (13) separate office spaces currently being leased by eligible start -up businesses and not - far -profit conimunity service providers in the SMCRA Area (See Exhibit B - Building .Site Plan & Floor Plan). The Mobley Building is also located in the "Low Intensity Office" (LO) zoning district which currently allows several different office related uses including the use of Beauty or Barber Shop which requires "special -use" approval. SMCRA staff recently received a start- up business proposal from Mr, Rodney Williams which requests the tease of currently available start -up business space in the SMCRA owned Mobley Building. The preliminary start -up business proposal was also reviewed by the South Miami Community Redevelopment Agency Board during their June 13, 2011 Meeting and received a general consensus in favor of the proposed start -up business use. In the -effort to encourage and promote aspiring start -up businesses in the Community Redevelopment Area, SMCRA staff recommends approval of the attached Special -Use application from Mr. Rodney Williams for the use of Beauty or Barber Shop in designated start -up business space #IB in the SMCRA owned Mobley Building located at 5825 SW 68i' Street, South Miami; f 1M 3�13. Board Members present constituting a quorum: Dr. Whitman (Chairman), Mr. Cruz (Vice - Chairman), Mrs. Yanoshik, Mrs. Beckman, Mr. Dundorf, and Dr. Philips. Board Member absent: Mr. Vitalinl City staff present: Mr. Christopher Bruno (Planning Director), Mr. Marcus Lightfoot (Permit Facilitator). City staff absent: Lourdes Cabrera (Principal Planner) City Attorney: Mr. Thomas Pepe. III. Administrative Matters Dr. Whitman notified the public that Planning Board Item #PB -11 -025 has been withdrawn. Mr. Brimo notified the Board that the next scheduled meeting of the Planning Board (September 13, 2011) is on the same day as the first Budget Bearing for the City. Mr. Brimo then stated that the meeting should be rescheduled for a later date. Because there were scheduling conflicts between the Board members, Mi . Brimo stated that he would check the availability of the Commission Chambers and notify the Board of these dates. IV. Public Bearings PB -11 -628 Applicant: Rodney Williams Location: 5825 SW 68 Street A Resolution relating to a request pursuant to Section 20- 3.4(B)(16) of the Land Development Code for Special Use Approval to locate a barber shop at 5829 SW 68 Street within the "LO" Low- Intensity Office zoning district; and providing an effective date. Ms. Beckman read the item into the record. Mr. Brimo presented the item to the Planning Board. Mr. Dundorf stated his concern of the existing carpeting not being consistent with the barber shop and wants to know if it will be removed or replaced. Mr. Brimo responded that the carpet would be removed due to it not being conducive to the barber shop use. Should the use no longer exist and the space become office use then carpeting would go down again or it would remain with hard flooring. Mr. Dundorf asked if this would be at the discretion of the City of South Miami or the Community Redevelopment Agency's (CRA). Mr. Brimo responded that it would be at the discretion of the CRA Dr. Philips asked if the City of South Miami is responsible for the furnishings for the barber shop. Mr. Brimo responded no we are not responsible. Dr. Philips asked if the business is licensed. Mr. Brimo responded yes, the business will be licensed. If this item is granted approval the barber shop would have to go through the licensing process of the City of South Miami. Dr. Philips stated that the applicant would not have to be a licensed barber. Mr. Brimo then responded that if the applicant is practicing to cut hair that he is required to be licensed. Dr. Philips asked if this Board is responsible for ensuring the licensing process. Mr. Brimo responded no not this Board. The Chairman opened the public hearing: The applicant Mr. Rodney Williams addressed the Boards questions. He stated that he currently has a mobile barber license by Miami -Dade County and the City of South Miami. Ms. McCain stated that she supports this business in the Mobley building, her only concern is if there is sufficient parking at the Mobley building for the clientele. The Chairman closed the public hearing: Ms. Beckman asked the applicant if he attended any small business classes to ensure his success as a business owner. She then asked if he had a proposed one year or a five -year plan. The applicant responded to Ms. Beckman he stated that he received grants in the, past from Miami - Dade County, a part of the requirement was to take a classes in small business. He has a five -year business plan for the proposed barber shop. She also asked the applicant who will he pay rent to. The applicant responded the rent will be paid to the CRA. Ms_ Beckman asked the applicant how much the rent will be a month. The applicant responded the rent will vary between the shared spaces within the building. Mr. Brimo responded that once this item is recommended for approval by this Board then it will go before the City Commission Board. Mr. Dundorf asked if signage will go up on the building. Mr. Brimo responded that there will be a pile on sign to identify the uses of the building. Mr. Dundorf asked the applicant if there were any road blocks or did he experience any difficulty The applicant responded that staff and the CRA were very helpful in this endeavor.
