A Resolution calling for the Mayor and City Commission to carry out
performance evaluations of the City Manager, the City Attorney, and the
City Clerk.
WHEREAS, Section 2 -4.4 of the City Code of Ordinances calls for annual evaluation of
the City Manager "each year within sixty (60) days before the city manager's contract
anniversary date."
WHEREAS, The City Manager has been employed by the City of South Miami for just
over one year without a formal performance evaluation by the City Commission, and no
evaluation is currently scheduled; and
WHEREAS, The City Attorney has been employed by the City of South Miami for half
a year without a formal performance evaluation by the City Commission, and no plan or
statutory provision exists for such an evaluation prior to contract expiration; and
WHEREAS, The City Charter provides that City Manager, the City Attorney, and the
City Clerk serve at the pleasure of the Commission; and
WHEREAS, Responsible supervision of employees and contractors requires careful and
thoughtful performance evaluation; and
WHEREAS, the Human Resources Director has expertise in matters of employee
evaluation; and
WHEREAS, The City Commission may wish to extend or renew the contracts of the
City Manager and the City Attorney in manners reflecting consideration of their performance;
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA, THAT:
Section 1. The City Commission hereby requests of the City Manager that the
Director of Human Resources work directly with the City Commission (rather than through the
City Manager who is to be evaluated) in crafting an annual performance evaluation instrument
that can be used effectively to evaluate the City Manager as per the terns of Section 2 -4.4 of the
City Code of Ordinances, and to guide the Commission in its effective administration.
Section 2. The City Commission hereby requests of the City Manager that the
Director of Human Resources work with the City Commission in crafting an annual performance
evaluation instrument appropriate to evaluate the City Attorney's fulfillment of his contractual
duties, and to guide the Commission in its effective administration.
Section 3. The City Commission shall complete a careful performance evaluation of
the City Manager, the City Attorney and the City Clerk.

Section 4. An ordinance amending Section 2 -4 of the City Code of Ordinances and
providing for annual evaluation of the City Attorney shall be drafted for consideration and vote
of the Commission.
Section 5. This resolution shall take effect immediately upon adoption.
