A Resolution, authorizing the City Manager to permit Chamber South, a 501 (c ) (6) non-
profit organization to hold its 40`" Annual South Miami Art Festival on November 5 -6, 2011,
in downtown South Miami on Sunset Drive from Red Road to US 1.
WHEREAS, Chamber South, a 501 (c ) (6) non -profit organization, has submitted a
special event application to hold its 401h Annual South Miami Art Festival on Sunset Drive from
Red Road to US 1, for November 5 & 6`", 2011; and,
WHEREAS, for the past 39 years, the South Miami Art Festival has been held in the City
of South Miami, sponsored through Chamber South; and,
WHEREAS, festival showcases approximately 100 artists from around the nation; and,
WHEREAS, this venue generates approximately 50,000 attendees who stimulate South
Miami's economy through various purchases made by the attendee's during this event from the
local merchants and restaurants; and,
WHEREAS, Chamber South is requesting a waiver of fees for 59 parking meters located
on Sunset Drive, and 5 meters located behind Chase Bank, and the street closure (Sunset Drive);
and,
WHEREAS, the waived amount would be for the street closure with a fee of $10,000 and
the parking fees of $3,200 ($1,600. X 2 days); and,
WHEREAS, applicant has paid for the following as of September 8`', 2011:
Deposit: $600
Application Fee: $ 60
and,
WHEREAS, the estimated cost for Police service is $7,580.00 and Public Works is
$6,353.11; and,
WHEREAS, upon receiving and reviewing the final billing from the Police Department
and Public Works Department, the applicant will render payment upon completion of the event.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA THAT:
Section 1. The City Manager is hereby authorized to permit Chamber South to hold the
401" Annual South Miami Art Festival on November 5 -6, 2011, in downtown South Miami on
Sunset Drive from Red Road to US 1.
Section 2. The City Manager is hereby authorized to waive the street closure fee of
$10,000 and the parking fees of $3,200.

Section 3. The City Manager is herby authorized to allow payment on the final billing for
the Police and Public Works Department upon completion of the event.
Section 4. This resolution shall take effect immediately upon adoption.

Background: Chamber South, a non - profit organization, has submitted a special event
application to hold its 40a` Annual South Miami Art Festival on Sunset Drive for
November 5 & 6'h, 2011.
For the past 39 years, the South Miami Art Festival has been held in the City of
South Miami, sponsored through Chamber South. This festival showcases
approximately 100 artists from around the nation. This venue generates
approximately 50,000 attendees who stimulate South Miami's economy through
various purchases during this event from the local merchants and restaurants.
To continue to have a successful event that not only draws a large attendance, and
showcases the City, Chamber South is requesting a waiver for the cost of 59
parking meters located on Sunset Drive and 5 meters located behind Chase Bank;
City parking lot in the amount of $3,200 ($1,600 X 2), and the street closure fee in
the amount of $10,000. In addition, under the new proposed road closure fee, the
amount would be $650.00 (1300 square feet X.25 X 2).
The applicant has paid for the following as of September 8`i', 2011:
Deposit: $600
Application Fee: $ 60
The estimated cost for Police service is $7,580.00 and Public Works is $6,353.11.
Upon receiving and reviewing the final billing from the Police Department and
Public Works Department, the applicant will render payment upon completion of
the event.

Extra -Duty Police Officers
Application � U
A police officer for employment that is indigenous to their law enforcement authority commonly referred to as "Extra- Duty"
employment. The following policies and procedures must conform in order to schedule a police officer for employment on a
temporary or infrequent basis:
'v The South Miami Police Department shall be the final authority in determining the minimum number of officers required to police a
particular event. If more than three officers are hired, a supervisor must also be hired The City Manager Office and South Miami
Police Department vdill determine the supervisor to officer ratio for lager events.
The Applicant will be required to corn pensaia the assigned officer for a minimum of three (3) hours even if the event is of a shorter
duration. Currently the rate for Extra-Duty Police Officer is S40 p ere hour & $50 per hour for Supervising Officer, plus a S3.00 charge for
radio usage for each officer.
The Applicant must compensate „he officers) for their services at least one (1) day prior to the start of the scheduled event that the
officers) will be assigned to. No monetary payment will be accepted. No payment by exchange of goods or services is acceptable.
r I", during a scheduled event, the Applicant determines that he /she needs to extend the time an officer(s) works at the assignment, the
Applicant shall compensate officer(s) for a full hour worked if the OfScer(s) works for more than 20 minutes andlor less 59 minutes
beyond the regularly scheduled time of the event.
Applicant must notify of a cancellation request of an Off -Duty Police Officer forty -eight (48) hours prior to the scheduled date of service.
Failure to do so will require the Applicant to compensate in- assigned officer for a minimum of three (3) hours.

EVEN'T'S, IN ORDER TO REVISE A POLICY RELATED TO
REQUIRING A SIGNATURE PETITION FROM WSINESSES
IMPACTED BY A SPECIAL EVENT, PROVIDING AN

WHEREAS, public property and public street locations within the City of South Miami are used
by organizations for special events which are beneficial to the City and its residents; and
WHEREAS, the City Commission at its Febru wy 18, 2003 adopted Resolution No. 27 -03 -11 S76
which set forth policies on funding special events; casts for special eveaM and policies to W followed by
organizations sponsoring special events within the City; and
WHEREAS, Section 4 of Resolution No. 27-03 -11576 sets forth, a policy requiring a signature
petition of businesses impacted by a street special event;and
WHEREAS, the City Commission desires to clarify file above policy by specifying that certain
long standing special events are exempt from the policy pertaining to a signature petition df businesses
impacted as set forth.in Section 4 ofltesoWon No. 27-03-11576.
Now, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISmON
OF THE CITY OF SOUTH MIAMI, FLOMDA, AS FOLLOWS-

A RESOLUTION OF THE MAYOR AND CITY COMMISSION
OF THE CITY OF SOUTH MIAMI, FLORIDA, RELATED TO
SPECIAL EVENTS, SETTING FORTH A POLICY ON FUNDING
SPECIAL EVENTS AND COSTS ASSOCIATED WITH SPECIAL
EVENTS AND; PROVIDING AN EFFECTIVE DATE.
WHEREAS, public property and public street locations within the City of South Miami are used
by organizations for special events which are beneficial to the City and its residents; and
WHEREAS, such special events may require City services and resources to be expended in order
to provide security, clean up, banner hanging, street blocking, covering of parking meters; and
WHEREAS, the Mayor and City Commission desire set forth a policy requiring reimbursement
to the City for all revenues lost or expenditures made for special events.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION
OF THE CITY OF SOUTH MIAMI, FLOIRDA, AS FOLLOWS:
Section I. All organizations sponsoring approved special events using public property or public
streets within the City of South Miami must reimburse the City for all City revenue loses, and
City expenditures associated with the approved special event.
Section 2. All organizations sponsoring special events using public property or public streets
within the City of South Miami must receive approval by resolution from the South Miami City
Commission. The resolution must include the estimated reimbursement amount to be paid to the
City for all City revenue loses and City expenditures associated with the approved special event.
Section 3. The resolution described in Section 2 above may also specify an additional monetary
contribution to be made by the organization to the City; the resolution shall specify as how the
additional monetary contribution is to be used by the City.
Section 4. All organizations sponsoring an approved special event which closes a public street
within the City of South Miami, must provide in advance, a petition signed by a majority of
businesses facing the street affected by the approved special event.
Section 5. All organizations sponsoring approved special events using public property or public
streets within the City of South Miami must agree in writing as to pay the actual the amount of
City revenue loses and final City expenditures associated with the approved special event.

Section 6. All organizations sponsoring approved special everts using public property or public
streets within the City of South Miami which have been allocated monetary grants in the adopted
City Budget, should pay for the required reimbursement from the designated monetary grant_
Section 7. This resolution shall be effective immediately after the adoption hereof,
