A Resolution authorizing the City Manager to execute a policy of insurance with
the Florida League of Cities, through the Florida Municipal Insurance Trust
(FMIT) for Workers' Compensation Insurance; further authorizing the City
Manager to execute a policy with Preferred Governmental Insurance Trust
(PGIT) for Property, General Liability, and Automobile Liability.
WHEREAS, the City insurance broker, Brown & Brown, has made solicitations for
insurance quotes for Workers' Compensation Coverage and for Property, General Liability, and
Automobile Insurance.
WHEREAS Brown & Brown attempted to present other options for the City's
insurance requirements, including quotations with insurance carriers holding an "A -" or better
rating from A.M. Best Company, but they were unable to obtain any such quotes other than
from FMIT and PGIT.
WHEREAS, the City Administration, in conjunction with the report from Brown &
Brown, recommends that the City continue coverage with the Florida League of Cities through
FMIT for Workers' Compensation Coverage for the 2011 -2012 Fiscal Year based upon the
current proposal; and
WHEREAS, the City Administration, in conjunction with the report from Brown &
Brown, recommends that the City continue coverage with the Preferred Governmental
Insurance Trust for Property, General Liability, and Automobile Insurance for the 2011 -2012
Fiscal Year based upon the current proposal;
NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA THAT:
Section 1. That the City Commission hereby authorizes the City Manager to execute
the renewal insurance policy for Workers' Compensation with FMIT for the 2011 -2012
Fiscal Year.
Section 2. That the City Commission hereby authorizes the City Manager to execute
the renewal insurance policy for Property, General Liability, and Automobile Insurance with
PGIT for the 2011 -2012 Fiscal Year.

Subject: Workers' Compensation, Property, General Liability and Automobile Insurance
Request: A Resolution authorizing the City Manager to execute the renewed policy with the
Florida League of Cities, through the Florida Municipal Insurance Trust (FART)
for Workers' Compensation Insurance; further authorizing the City Manager to
execute the renewed policy with Preferred Governmental Insurance Trust (PGIT)
for Property, General Liability, and Automobile Liability; providing for an effective
date.
Reason/Need: The City solicited and received proposals for the City's Workers' Compensation,
Property; General Liability and Automobile Insurance coverage for FY 2011 -2012 from
carriers currently righting municipal business in South Florida. The following table
summarizes the responses received and the City Manager's recommendation.
As set forth above, the City Manager recommends that the coverage continue to be
divided between the two carriers. FMIT offers the most competitive rates for Workers'
Compensation Insurance. The City continues to receive the company's preferred rating
because of the continuing coverage, including a 5 %. credit for its Drug Free Work Place
policy and a 2% credit for its Safety Policy,
The City Manager recommends that the City renew its policy with PGIT for its Property,
General Liability and Automobile Insurance coverage. The PGIT proposal contains the
most favorable rates for all coverage except Workers' Compensation.
Brown & Brown, Inc. presented the proposal on behalf of PGIT and attempted to present
other options for the City's insurance placement from other carriers with an "A -" or
better rating from A.M. Best Company. No other quotes were presented.

Employee Dishonesty - Blanket Basis
This coverage is used to insure against loss of money, securities or other property belonging to
you, or for which you are liable, that is caused by employee dishonesty. It pays for any one loss

Forgery or Alteration

General liability coverage provided to a named insured (you) by an insurer could be modified to
extend to other parties. These other parties are commonly referred to as additional insureds.
Modifications (endorsements) to the named insured's policy could be used to provide similar
benefits enjoyed by the named insured to the additional insured. Because of changes to these
endorsements, the additional insured may no longer enjoy the same benefits. Under these new
endorsements, liability that is based on the sole negligence of the additional insured may no
longer be covered. The State of Florida's Office of Insurance Regulation approved changes to
these policy endorsements effective July 1, 2004.
The absence of insurance coverage and the agreement to contractual terms may not free you of
the responsibility to pay on behalf of the additional insured liability arising out of their sole
negligence.
Florida law allows you to assume liability on behalf of another party by way of a
contractual agreement. In fact, the law allows you to assume the liability for suits that
may be the result of the sole negligence of the other party in the contract. In other
words, contractually you would be accepting and paying for claims that may arise from
situations that are not even your fault.
While we are not necessarily aware of the individual contracts you may have` entered
into, we feel it is our duty to notify you that there Is a possibility you could have a claim
that is not covered by insurance. Our recommendation to you would be to have your
contracts reviewed by your attorney to determine if you have assumed such liability and
what your legal options are.

SPECIAL CAUSES OF LOSS COVERAGE
This coverage will protect covered property against direct loss arising from any cause not
specifically excluded. The advantage of this form is that the insurance company must prove
that a loss is specifically excluded in order to deny coverage under the policy.
REPLACEMENT COST VALUATION
This loss valuation method pays for the cost to repair or replace damaged items with like kind
and quality without deduction for depreciation. This is important since you could face a
substantial loss if you must replace property at today's prices but receive only the depreciated
value of the property that was destroyed.
ACTUAL CASH VALUE VALUATION
This valuation method pays for the cost to repair or replace damaged property with like kind and
quality, less reasonable deductions for wear and tear, deterioration and economic
obsolescence.
DEDUCTIBLE
A policy may include a deductible in its provisions. This limit specifies the amount that will be
deducted from any payment made to you because of a covered loss.
BLANKET INSURANCE
This coverage allows for a single limit of insurance to apply to two or more property items at one
location, or to two or more kinds of property at several locations, instead of a specific amount
applying to a specific subject of insurance, it allows you to shift property values with no
impairment of recovery, as long as the total amount of insurance carried complies with the
coinsurance requirement stated in the policy.
AGREED VALUE VALUATION
This coverage is used to remove the coinsurance requirement for covered property. With it your
company agrees that the amount of coverage purchased is adequate,, and any coinsurance
requirements are waived if the limit of insurance equals the agreed value.
MECHANICAL & ELECTRICAL BREAKDOWN COVERAGE
Boiler & Machinery insurance covers direct damage to "covered property" when caused by
sudden and accidental BREAKDOWN and includes as a covered peril Electrical Arcing.
Covered Property means any mechanical, electrical or boiler equipment on premises, such as
(but not limited to): machinery & equipment, air - conditioning units, elevators, phone systems
etc.

This coverage insures you against all claims arising from your ownership, maintenance or use
of premises and your operations in progress.
PRODUCTS /COMPLETED OPERATIONS COVERAGE
This coverage is used to insure against claims arising out of bodily injury and property damage
that results from products you have sold, manufactured, handled, distributed or disposed of, or
for work you have performed, provided the accident occurs away from premises you own or
rent.
PERSONAL INJURY LIABILITY
This coverage will protect you against claims alleging false arrest, libel, slander, malicious
prosecution, or wrongful entry or eviction.
ADVERTISING LIABILITY
This coverage is used to insure against claims of libel, slander, product disparagement, piracy,
or infringement of copyrights, arising out of the advertising of your goods, products or services.
FIRE LEGAL LIABILITY
This coverage insures against your legal liability arising from damage to structures rented to
you, for the peril of fire.
MEDICAL PAYMENTS
This coverage will reimburse, without regard to your liability, all reasonable medical expenses
incurred by persons as a result of bodily injury sustained by accident as defined in your policy.

TurnKey Recovery - In an effort to improve the mitigation process and significantly reduce the financial impact of a
loss can have on a Member's ability to recover, FMIT TurnKey Recovery Program is offered to Members.
Project costs are approved and paid to certified vendors directly by Synergy for the FMIT in order to reduce
Member's out -of- pocket costs. FMIT TurnKey Recovery helps to minimize the financial exposure the SOV
Claims can have on Members net cash -flow by eliminating the recovery cost burden and the reimbursement
process.

Special Investigations Unit (SIU) • Insurance fraud costs each Florida family approximately $1,400 a year
in additional premiums, and is the number two white collar crime In America. The Special Investigation Unit (SIU)
was created in 1999 to investigate suspected fraud to help reduce the cost and amount of fraud for the Florida
Municipal Insurance Trust (FMIT) Members.
As of 2010, fraud investigations and prosecutions have resulted in over $5,5 million in cost savings and more
that $1.8 million dollars in restitution ordered on FMIT claims, The SIU was recognized by the State of Florida
Governor and Cabinet in 2009 for its work in the fight against insurance fraud.
