RESOLUTION NO.: 153-11-13467 A Resolution authorizing the City Manager to execute a construction contract with JVA Engineering Contractor, Inc. in the amount of $15,120 for Pinecrest Villas Traffic Calming Speed Tables be charged to People's Transportation Plan 124 - 1730 - 541 -6490. WHEREAS, the Mayor and City Commission wishes to provide traffic calming to Pinecrest Villas along SW 76th Street and SW 78th Street, and WHEREAS, the City requested and bids were received from JVA Engineering Contractor, Inc., TJ Pavement Corp. and Homestead Concrete & Drainage at $15,120, $15,180 and $16,089, respectively. WHEREAS, JVA Engineering Contractor, Inc. submitted a bid of $15,120.00, which is the lowest, most responsive and most responsible bidder for Pinecrest Villas Traffic Calming Speed Tables. WHEREAS, the total construction cost is $15,120, funded by People's Transportation Plan from Account Number 124 - 1730 - 541 -6490; WHEREAS, the Mayor and City Commission desires to authorize the City Manager to execute a construction contract with JVA Engineering Contractor, Inc. for three speed tables for Pinecrest Villas Traffic Calming in an amount of $15,120. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA THAT: Section 1: The City Manager is hereby authorized to execute the construction contract and issue a Purchase Order to JVA Engineering Contractor, Inc. for the Pinecrest Villas Traffic Calming Speed Tables in the amount not to exceed $15,120. Section 2: The expenditure shall be charged to People's Transportation Plan Account Number 124 - 1730 - 541 -6490, which has account balances of $298,000, before this resolution was adopted. Upon concurrence from a majority of the residents, and the City Commission, Miami Dade County has approved the installation of the three speed tables at (1) SW 76th Street between SW 59th Place and SW 60th Avenue; (2) SW 78th Street between SW 61st Avenue and SW 60th Avenue and (3) SW 78th Street between SW 59th Court and SW 59th Avenue, The City received 3 bids in response to the solicitation. As a result, it was determined that the installation of a speed hump on SW 76 Street and SW 78 Street will enhance the traffic along these corridors. However, the two closely spaced speed humps on SW 78 Street may reduce the effectiveness. Therefore, it is suggested that only one speed hump should be installed on SW 78 Street. Moreover, speed humps will not be considered at the approaches to a horizontal or vertical curve where visibility of the hump is restricted. The speed humps will not be considered within 250 feet of a traffic signal, within 50 feet of an intersection, or in front of a driveway (please see attached policy on speed humps). Furthermore, the City must execute an intergovernmental agency agreement. An electronic copy of this document is attached with this email. Signed and sealed design plans must be submitted to our Department for review. 100% of the residents /property owners immediately adjacent to the proposed speed hump and two- thirds (2/3) of the residents /property owners of the blocks shall concur with the installation of the speed hump. The purpose of the traffic management projects is to address speeding and traffic intrusion in local residential streets. 9/9/2011 Page 5 of 5 The City initiated a traffic calming study for both neighborhoods to perform traffic data collection and analysis, as well as development of traffic calming alternatives for the study areas. The study resulted in the following recommendations: Coco um Terrace Neighborhood Most recommended improvements for this area have been implemented, including the lane closure of the SW 70th Street and installation of traffic circles. The items below are pending and are planned to go into design soon, 1. Installation of six speed tables between: SW 64th Street and SW 66th Street at SW 641h Court • SW 63rd Court SW 62nd Court SW 70P' street and Sunset Drive/ SW 72nd Street at: • SW 601 Court SW 63rd Court • SW 63rd Avenue 2. Install speed table / street narrowing west of SW 62nd Avenue, on SW 69th Street and SW 68th Street, to create a transition for traffic operation between commercial and residential areas along SW 62nd Avenue, Pinecrest Villas Neighborhood;. The traffic study recommends the Installation of three speed tables at: o SW 76th Street between SW 59th Place and SW 60th Avenue. • SW 78th Street between SW 60th Avenue and SW 61st Avenue. SW 78th Street between SW 59th Avenue and SW 59th Court. I have included a map of each area for your reference. Note that the locations for the Pinecrest Villa Speed tables are highlighted in yellow. Based on our conversation yesterday, please describe the concurrence requirements from the residents and inform CSMPWD of any requirements for Miami Dade Public Works approval. NOW THEREFORE, the CITY and the COUNTY agree as follows: 1. The recitals set forth above are incorporated herein by reference. 2. The CITYwill only install and maintain thefollowing designated types oftrafficcontrol devices and only on those local municipal streets operated and maintained by the CITY within its boundaries: (List devices) Three speed tables located at: 1. SW 76th Street between SW 59th Place and SW 60th Avenue. 2. SW 78th Street between SW 616t Avenue and SW 60th Avenue. 3. SW 78th Street between SW 59th Court and SW 59th Avenue. Traffic calming devices may be installed on local municipal streets only after an appropriate traffic engineering study has been performed and sealed and signed plans have been submitted to the Public Works Department of the COUNTY for its review and approval. 3. The CITY shall attach a decal to the back of the sign panels indicating ownership and date of installation. 4. The CITY assumes sole and complete responsibility for the maintenance of all such signs that are installed by the CITY within its boundaries. 5. The CITY assumes sole and complete liability for any accidents and /or injuries which may or are alleged to occur or arise out of the installation, operation or maintenance of said traffic control devices, and hereby indemnifies and saves harmless the COUNTY from any and all claims of negligence as a result of the installation, operation or maintenance of said signs. 6. All traffic control signs installed by the CITY in accordance with this AGREEMENT shall conform to the applicable requirements established by the following publications: • Florida Department of Transportation's Standard Specifications for Road and Bridge Construction. • Manual on Uniform Traffic Control Devices for Streets and Highways, U.S. Department of Transportation Federal Highway Administration (ANSI D6. le- 1989), including latest revisions. • Standard Highway Signs, U.S. Department of Transportation, Federal Highway Administration. • Miami -Dade County Public Works Manual (available from the Public Works Department, Reproduction Services, 111 NW 1 Street, Suite 1604, Miami, FL 33128) 7. For installation of traffic control devices, the CITY shall hire a COUNTY licensed contractor or perform the work in -house by the CITY Public Works crew. 8, Should the CITY install street name signs at the same site where a stop -top street name exists, then the CITY shall utilize the other corners of the intersection. Subsequently, the CITY shall remove the COUNTY'S stop -top street name signs by an approved sign contractor. All signs and hardware removed shall be dismantled and returned to the Traffic Signals and Signs Division of the COUNTY'S Public Works Department. 9. The CITY shall be responsible for keeping records of any and all installations and repairs, and furnishing pertinent documents as and when said records may be requested. 10. Failure to carry out any of the duties and responsibilities assumed herein by the CITY may result in termination of this AGREEMENT, at the sole discretion of the COUNTY. WITNESETH: That, the Contractor, for the consideration hereinafter fully set out, hereby agrees with the Owner as follows: 1. The Contractor shall furnish all labor, materials, equipment, machinery, tools, apparatus, and transportation necessary to perform all of the work shown on the Drawings and described in the Project Manual the Contractor shall furnish all the materials, and perform all of the Work as provided for in the Bid Documents and Construction Documents, drawings, plans, specifications and documents and shall do everything required by this Contract and the other Contract Documents. 2. The Contractor shall commence the Work to be performed under this Contract on a date to be specified in a written order of the Owner and shall complete all Work hereunder within the length of time stipulated in the Bid. 3. The Owner hereby agrees to pay to the Contractor for the faithful performance of this Contract, subject to additions and deductions as provided in the Bid Form, in lawful money of the United States, the amount of: Fifteen thousand One Hundred and Twenty Dollars; ($15,120.00), Lump Sum. 4. The Owner shall make monthly partial payments to the Contractor on the basis of a duly certified and approved estimate of Work performed during each calendar month by the Contractor, less the retainage provided in the General Conditions, which is to be withheld by the Owner until completion and acceptance of the complete project in accordance with this Contract and until such Work has been accepted by the Owner. 5. Upon submission by the Contractor of evidence satisfactory to the Owner that all payrolls, materials bills, and other costs incurred by the Contractor in connection with the construction of the Work have been paid in full, final payment on account of this Contract shall be made within sixty (60) days after the completion by the Contractor of all Work covered by this Contract and the acceptance of such Work by the Owner. 6. In the event that the Contractor shall fail to complete the Work within the time limit stipulated on the Bid Form in #5, or the extended time limit agreed upon, as more particularly set forth in the Contract Documents, liquidated damages shall be paid at the rate of $278.00 dollars per day, plus any monies paid by the City to the Consultant for additional engineering and inspection services associated with such delay. 7. It is further mutually agreed between the parties hereto that if, at any time after the execution of this Contract and the Surety Bond hereto attached for its faithful performance and payment, the Owner shall deem the Surety or Sureties upon such bond to be unsatisfactory, or if, for any reason such bond ceases to be adequate to cover the performance of the Work, the Contractor shall, at its expense within five (5) days after the receipt of notice from the Owner so to do, furnish an additional bond or bonds in such form and amount and with such Surety or Sureties as shall be satisfactory to the Owner. In such event, no further payment to the Contractor shall be deemed to be due under this Contract until such new or additional security for the faithful performance of the Work is furnished in manner and form satisfactory to the Owner. 8.
