Res No 261-12-13818RESOLUTION NO. 261-12-13818 A Resolution of the City of South Miami advocating the prohibition of sales and possession of automatic and semi automatic weapons. WHEREAS, the drafters of the Second Amendment ( "Amendment Il ") to the United States Constitution never envisioned automatic or semi - automatic weapons when the right to bear arms was first conceived; and WHEREAS, the one of the principal goals of the United States Constitution set forth in the preamble to the Constitution, is "to insure domestic Tranquility;" and WHEREAS, the United States Supreme Court has held that there are longstanding prohibitions and restrictions on firearms possession that are consistent with the Second Amendment notwithstanding the fact that the Second Amendment protects an individual's right to possess a firearm, unconnected to service in a militia; and WHEREAS, the proliferation of automatic and semi - automatic weapons are now a growing problem to law enforcement and to the population's domestic tranquility as a whole. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA: Section 1. The City of South Miami, Florida, hereby advocates the prohibition of the sale and possession of automatic, aPA semi - automatic, and assault weapons and requests that other municipalities, counties and state governments pass similar resolutions to let our voices be heard in Washington. The City Clerk is hereby directed to send a copy of this resolution to the Governor, the Florida Senate President, and the Florida House Speaker. Section 2. If any section clause, sentence, or phrase of this resolution is for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect the validity of the remaining portions of this resolution. Section 3. This resolution shall become effective immediately upon adoption by vote of the City Commission. PASSED AND ADOPTED this 18`h day of December, 2012.
