WHEREAS, the Community Redevelopment Agency donated and conveyed the title of the
property to the Miami -Dade Affordable Housing Foundation to construct a new LEED Silver certified,
affordable single family residence; and
WHEREAS, the property is a non - conforming lot of record requiring said variances in
order to construct the new single family residence as presented; and
WHEREAS, application No. PB -12 -034 was submitted to the Planning Board by
applicant Miami -Dade Affordable Housing Foundation; said application requesting approval of
five variances from Section 20- 3.5(E) to permit the construction of a new one - story, LEED
(silver) affordable single family residence at the NE corner of SW 62 Avenue and SW 62
Terrace within the City's Community Redevelopment Area in the RS -4 zoning district; and
WHEREAS, the approval of a variances requires a recommendation from the Planning
Board and the approval of the City Commission after a public hearing; and
WHEREAS, at its November 13, 2012 meeting the Planning Board, after public hearing,
voted 4 ayes; 2 nays to recommend approval of the variances requested; and
WHEREAS, the Mayor and City Commission of the City of South Miami desire to
accept the recommendation of the Planning Board,

Section 1. The recitals set forth in this resolution are true, that they are supported by
competent substantial evidence and that they are incorporated into this resolution by reference.
Section 2. That the subject application submitted by applicant Miami -Dade Affordable
Housing Foundation, requesting approval of the following variances from Section 20- 3.5(E) to
permit the construction of a new one - story, LEED (silver) affordable single family residence on
a vacant non - conforming lot of record to allow:

SUMMARY OF REQUEST
The subject parcel is a legal non - conforming lot of record that was owned by the City of South
Miami Community Redevelopment Agency, and which was platted in 1918 prior to the
establishment of the current dimensional requirements for the RS -4 zoning district. On
November 2011, the Community Redevelopment Agency donated and conveyed the title of the
referenced property to the Miami -Dade Affordable Housing Foundation (Developer) to construct
a new LEED Silver certified, affordable single family residence. The City's Land Development
Code requires any new construction to meet the zoning standards for the particular district where
it is located; in this instance, within the RS -4" Small Lot Single - Family Residential District. The
applicant in their attached hardship letter claims that the substandard size of the property
prohibits the use of the property without the granting of the variances requested.
Miami -Dade Affordable Housing Foundation Inc., originally submitted a request for eight
variances to construct a LEED Certified affordable home on the subject property. In May of
20125 the Planning Board reviewed the original request for eight variances and recommended
denial. Subsequently on June 5, 2012, the City Commission reviewed the request and also denied
the variances by a vote of 1 yea; 4 nays.
The Community Redevelopment Agency (CRA) Board re- reviewed the proposal for the
construction of the proposed home, and on September 10, 2012 approved the attached Resolution
No. CRA 62 -12 -602 for the submittal of a redesigned proposal to the City's Planning Board and
City Commission with a reduced request, from eight to five variances. The revised application

was reviewed by the Planning Board on November 13, 2012, and following a public hearing,
voted to recommend approval of the request by a vote of 4 yea's; 2 nay's.
The applicant is requesting approval of the following five variances to construct a new affordable
single- family residence on a vacant lot located at the NE corner of SW 62 Avenue and SW 62
Terrace. This property has not yet been assigned a physical address.
Variances Requested:
1. To allow a 37.5' frontage where a 60' frontage is required.
2. To allow development on the lot which has 3,525 square feet where 6,000 square feet is
required.
3. To allow 12' front setback when 25' is required.
4. To allow 6.67' side street setback when 15' is required.
5. To allow maximum building coverage of 37% when 30% is required.
APPLICABLE REGULATIONS (See ATTACHMENTS)
Land Development Code Section 20- 3.5(E) Dimensional Requirements; Single- Family
Residential Districts — One -Story
STAFF OBSERVATIONS
(a) The applicant is proposing to build a new one -story single family residence consisting of
1,299 square feet on the referenced site. This is a reduction of forty -six (46) square feet from the
original 1,345 square feet previously proposed design for this site.
(b) The proposed building coverage of 1,299 square feet or 37% of the existing 3,525 square feet
site is 501 square feet less than the 1,800 square feet or 30% maximum building coverage
allowed; if the lot size would be confirming at 6,000 square feet.
(c) The proposed development meets the other requirements of the development code and will
require an appearance before the Environmental Review and Preservation Board following
review and recommendation by the Planning Board and review and approval by the City
Commission.
(d) The subject site is surrounded by the following properties and zoning districts: RS -4
Residential to the south and east; RS -3 Residential to the north and west.
(e) In June 2008 the City Commission amended the Land Development Code to add specific
criteria for judging variance requests. LDC Section 20 -5.9 (H) now requires that all variance
decisions shall be based on an affirmative finding as to each of the following criterion:
1. The variance is necessary to relieve particular extraordinary conditions relating to a specific
property;
The requested lot frontage variance is necessary to use the property for the construction
of a new single family residence.

from other properties under similar zoning restrictions,
If the intention is the construction of a new single family residence, then a denial of the
variance would be a hardship on the owner by preventing the property from being
built with said residence.
3. The extraordinary conditions and circumstances do not result from the actions of the
applicant;
Prior to being transferred to the current owner, the property was a legal non-
conforming platted lot of record
4. The requested variance is the minimum variance necessary to make possible the reasonable
use of the land, building or structure;
The granting of the requested variances is the minimum required in order to
construct a single family residence.
5. That the annroval of the variance will be consistent with the general intent and purpose of the
Land Development Code, and will not be injurious to the neighborhood or otherwise
detrimental to the public welfare.
The approval of the variance is consistent with the City's objective to provide affordable
housing within the Community Redevelopment Area, and will allow a vacant property to
be used and for the City to receive property tax and other revenues. In addition the
proposed use is the type of use consistent with the RS'-4 zoning district and will be
compatible with the abutting and surrounding properties. These objectives are consistent
with the stated objectives of the adopted comprehensive plan, community redevelopment
plan and land development code. The variance requested will have no impact on
surrounding properties.
RECOMMENDATION
Staff recommends approval of the revised request for the five (5) variances, with the conditions that the
structure is constructed in accordance with the agreement between the South Miami Community
Redevelopment Agency and the Developer.

reduction in total variances required from eight to five; and
WHEREAS the following is a list of currently required land development
variances required to construct the L.E.E.D. certified home:

Background
During the August 10, 2012 Meeting, the Board requested a formal resolution be returned for the

conveyed property identified as Folio No. 09 -4025- 009 -0240.

• . Accommodate 2 cars by adding I set of additional concrete strips; and
• Increase east side setbackfrom 5'to 7.5'

then provided the Board with a presentation board of the current state of the housing
development along 62nd Avenue and 62nd Terrace. She stated that there are several different
family sizes and various lot sizes, which says that one size does not fit all and it's good to have
variety. Mr. Fernandez asked if the adjoining lot to this corner lot, does it suffer the same
existing non conforming lots. Mr. Brimo responded that is correct, most of the lots in the area are
substandard lots of record. Mr. Cruz asked Mr. Brimo how many more lots like this are there.
Mr. Brimo responded yes, we do have lots like this in this area however I will inform the Board
at the November 27"' meeting of how many more lots are to come before the Planning Board.
Mr. Cruz then asked if the Planning Board approves five of the variances out of the eight does
that mean that this becomes the standard. Mr. Brimo replied no, variances are reviewed
independently on their own merit. Mr. Fernandez then asked Mr. Brimo if there is a zoning
designation that this particular application would be categorized into. Mr. Brimo responded no
there is not one in our current zone; a new classification would have to be created. Dr. Hauri
stated that she is in favor of the zoning variance. Dr. Whitman stated that this request went

through this Board to the City Commission who in turn denied the variance. He also stated that
the Community Redevelopment Agency Board (CRA) decided to send it back to the Planning
Board; of the CRA board five of those members are on the City Commission. Mr. Brimo
responded yes that is correct. Dr. Whitman then asked was this vote unanimous and could we
surmise that this would then pass at the City Commission if brought before them again, what was
the vote when it was last seen by them. Mr. Brimo responded that the CRA Director Mr. Stephen
David stated that it was a unanimous vote. Dr. Whitman then addressed Mr. David asking what
the direction of the City Commission was when this vote went forth: Mr. David stated that the
CRA was created to eliminate blighted areas and conditions within the CRA district. He then
stated that a vacant lot is a blighted condition; the CRA is intent to build on this particular lot. He
also stated that there are five other homes that are presently under construction and this is the
sixth of this project. He stated that CRA Board was so intent on this project going forth that
when they approved the agreement proposed by the developer they allocated additional funding
source because they knew that custom architectural plans would be needed for this particular
site. He then stated the CRA Board approved this item unanimously; will it be approved by the
City Commission this time, I'm not sure how many votes are required at the Commission level.
Dr. Philips asked Mr. David if the CRA Board saw these plans that were provided to the
Planning Board for review on tonight. Mr. David responded yes they saw these revised plans, the
developer agreed to reduce the variances from eight to five which was an architectural expense
in itself. He then stated that after reviewing these revised plans the CRA Board gave approval for
resubmission to the Planning Board. Ms. Manning stated that the previous five lots that were
approved were larger in size than this particular lot. Mr. Dundorf stated that the amounts of
variances requested are extraordinary, he feels that there are not any extenuating circumstances
or hardships given to approve this request.
The Board then discussed this item as a whole.
