A Resolution authorizing the City Manager to permit South Miami Rotary, a
non - profit organization to hold its 29th Annual South Miami Rotary Art
Festival on February 23 & 24, 2013, in the South Miami downtown area on
Sunset Drive.
WHEREAS, South Miami Rotary, a non - profit organization, has submitted a Special
Event Application; and,
WHEREAS, for the past 29 years the South Miami Rotary Art Festival has been held
in the City of South Miami, and sponsored through South Miami Rotary; and,
WHEREAS, the applicant has requested permission to hold its event on February 23 &
24, 2013; and,
WHEREAS, the applicant has paid for the deposit, application, Street and pole banner
fees, totaling $1,260.00; and,
WHEREAS, the applicant will pay for all services rendered by the Police and Public
Works Departments in an estimated amount of $14,084.69; (Police $7,730.00 and Public
Works $6,354.69), and,
WHEREAS, the Resolution #155 -03- 11705, revising a policy related to the requiring
signature petition from businesses as previously established through Resolution #27 -03 -11576
the South Miami Rotary will not need to obtain signatures for this event; and,
WHEREAS, Resolution #85 -06- 12226, dated June 6, 2006, waives the requirements
established in Resolution #27- 03- 11576, "Mayor and City Commission agree to close Sunset
Drive for the annual event ", and "Rotary shall not be required to reimburse the City for lost
parking revenues "; and,
WHEREAS, Resolution #229

NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA.
Section 1. The Acting City Manager is authorized to approve the 29`' Annual South
Miami Rotary Art Festival event to be held on February 23 & 24, 2013, downtown South
Miami on Sunset Drive.
Section 2. The Acting City Manager is hereby authorized to waive the street closure fee of
$625.50; and to allow payment on the final billing for the Police, Public Works and street closure
(if not waived) upon completion of the event in the approximate amount of $14,710.19 " -- $14,084.69.

Section 3. If any section clause, sentence, or phrase of this resolution is for any reason
held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not
affect the validity of the remaining portions of this resolution.

Background: South Miami Rotary, a non - profit organization, has submitted a Special Event Application
to hold its 291h Annual Arts Festival on February 23 & 24, 2013. For the past 29 years, the
South Miami Rotary Art Festival has been held in the City of South Miami, and sponsored
through South Miami Rotary.
The applicant has paid a deposit of $600, fee application of $60.00, Over the Street Banner
Request of $300, and Pole Banners of $300, totaling $1,260.00.
The applicant will pay for all services rendered by the Police ($7,730.00) and Public Works
($6,354.69) in a total estimated amount of $14,084.69.
The applicant has attached a copy of Resolution #155 -03- 11705, revising a policy related to
to requiring signature petition from businesses as previously established through
Resolution # 27- 03- 11576, and according to this resolution, the South Miami Rotary
will not have to obtain signatures for this event according the above mentioned resolution.
Resolution # 85- 06- 12226, waives the requirements which were established in
Resolution #27- 03- 11576. In accordance to Resolution #85- 06- 12226, dated June 6,
2006, "Mayor and City Commission agree to close Sunset Drive for the annual event ",
and "Rotary shall not be required to reimburse the City for lost parking revenues."
Resolution # 01 -11- 13315, dated February 18, 2003, and Resolution #229 -11- 13543, dated
December 20, 2011, with a waiver of the fee for the street closure.
The applicant is seeking a waiver for the street closure. The proposed street closure fee
is $625.50, (1,251 linear feet X.25 = $312.75 X 2).
Final approximate billing in the amount of $14,084.69, will be given to the City upon
completion of this event. (This amount does not include the fee for street closure).

INDEMNIFICATION AGREEMENT

WHEREAS, the Applicant has submitted a Special Event Permit Application to the City for (event title)

1. The above recitals are true and correct.
2. Applicant agrees to indemnify, defend and hold the City, its officers, affiliates, employees, successors and assigns,
harmless from and against any and all such claims, suits, actions, damages, or causes of action arising as a result of
the Special Event, or of the condition of the site on which the Special Event is held including any personal injury or
loss of life, or damage to or loss of property, and from and against any costs, attorney's fees, expenses or liabilities
incurred in and about the defense or settlement of any claims, and the investigation thereof.
3. Permits for Special Events must be on event site at all times.
4. No Street shall be closed without authorization from the City of South Miami Public Works Department and Police
Department.
5. Traffic shall be maintained in accordance with Florida Department of Transportation (FDOT), Miami -Dade County
standards and any additional requirements by the City of South Miami Public Works Department and Police
Department.
6. Event areas shall be restored to equal or better condition than they were before the event started.
7. If all 'restoration work is not performed within 30 days of work completion, the City of South
Miami Public Works Department may restore the event area and charge the applicant for the cost of restoration
plus a minimum of 15% for administrative fee and any additional incidental fees.
8. Applicant must pay all fees prior to the start of their event(s).
94 Applicants that receive approval for their event more than thirty (30) days in advance shall notify the City of South
Miami Special Event/Marketing Coordinator at least forty-eight (48) hours prior to start of their event.
10. Any damage to private property shall be restored to its original condition or better and as accepted by the Owner.

A police officer for employment that is indigenous to their law enforcement authority commonly referred to as "Extra- Duty"
employment. The following policies and procedures must conform in order to schedule a police officer for employment on a --
temporary or infrequent basis:
➢ The-South Miami Police Department shall be the final authority in determining the minimum number of officers required to police a
particular event. If more than three officers are hired, a supervisor must also be hired. The City Manager Office and South Miami
Police Department will determine the supervisor to officer ratio for larger events.
➢ The Applicant will be required to compensate the assigned officer for a minimum of three (3) hours even if the event is of a shorter
duration. Currently the rate for Extra -Duty Police Officer is $40 per hour & $50 per hour for Supervising Officer, plus a $3.00 charge for
radio usage for each officer.
➢ The Applicant must compensate the officer(s) for their services at least one (1) day prior to the start of the scheduled event that the
officer(s) will be assigned to. No monetary payment will be accepted. No payment by exchange of goods or services is acceptable.
➢ If, during a scheduled event, the Applicant determines that he/she needs to extend the time an officer(s) works at the assignment, the
Applicant shall compensate officer(s) for a full hour worked if the Officer(s) works for more than 20 minutes and /or less 59 minutes
beyond the regularly scheduled time of the event.
Applicant must notify of a cancellation request of an Off-Duty Police Officer forty -eight (48) hours prior to the scheduled date of service.
Failure to do so will require the Applicant to compensate the assigned officer for a minimum of three (3) hours.

Dear Mr. Mirabile,
With this letter I am delivering to the city a package containing the Special Event Permits
Application Packet and related documents for the 29h annual South Miami Rotary Art Festival
February 23 -24, 2013.
Enclosed are checks in the amount of $60 for the Special Event Application Fee, $600 for the
Security Deposit, and $300 for the installation and removal of our street banner and $300 for
the installation and removal of the 7 pole banners.
We request that in the Resolution drafted for the Commission you please include waivers from
the following sections of Ordinance 15B:
6.3 Which requires us to obtain signatures of approval from a majority of the business
affected by the street closure.
6.4 Those provisions pertaining to road closure costs and lost parking revenue
6.6 The requirement that costs of police and any other department employment be paid
prior to the permit being issued.
As you know, all of these waivers that we request are in keeping with the long standing policy
of the City of South Miami which has always recognized the value to the city of the South Miami
Rotary Art Festival. We bring approximately 30,000 visitors to the city over a two day period,
many of whom return throughout the year to spend money in the downtown area.
Kindly note that overall net parking revenues increase in South Miami as a result of both the
Chamber and Rotary Art Festivals. The thousands of patrons that visit the festivals fill up the
municipal parking garage and other metered locations throughout the Town Center that
typically would not be filled during the same hours of operation.
Profits from our festival are used to fund an annual college scholarship for a South Miami
student. We have been giving scholarships to needy children in South Miami for at least 20
years.
Our free dictionary and atlas project in conjunction with the Miami -Dade Public Library System
awards over 3000 dictionaries and atlases to South Miami 3`d and 5th grade students,
respectively, as well as to several at -risk schools throughout the county.
We would be happy to innumerate some of our other projects which vary according to needs of
the community and the world not the least of which was the lighting of Rotary Field at Murray
Park in South Miami.
Prior to 2011 the City of South Miami provided grants to non - profits such as Rotary to help
defray Police and Public Works expenses incurred. Last year we understood that you had
budget problems, but continued to show the City as a sponsor in our publicity in hopes that you
will be able to return to that status when budget allows. The city has always recognized the
value of our art festival to bring many return visitors to South Miami raising awareness of all
that the city has to offer.

With this letter I am informing you of our intent to once again serve beer at the 29th annual
South Miami Rotary Art Festival February 23 --24, 20130
At the present time we are negotiating with more than one vendor to determine our best
course of action regarding the beer sales. We will either have a fully insured vendor who is
licensed to sell beer, or we will sell the beer ourselves after obtaining a license and additional
insurance.
In addition, we will be having a reception in the Food Court on Saturday night from 6:30 pm-
8:30 pm. We plan to have local restaurants show off their wares in a sophisticated party
atmosphere.
When we have more definitive plans for these two items, we will notify the city.

The South Miami Rotary Art Festival would like to request permission to display 7
(seven) light pole banners in the City of South Miami for the 2013 South Miami Rotary
Art Festival. The light pole banners would be displayed on within the downtown South
Miami area on Sunset, SW 73rd St and or SW 74d' St. as determined in consultation with
Public Works. Installation of the light pole banners would be on as close to the festival as
possible in compliance with the rules of the City of South Miami, and removal of the
banners would be after the festival, which is February 23 -24, 2013, as soon as Public
Works is able to do so.
