A Resolution approving the current design concept submitted by Di Pompeo
Construction Corporation and authorizing the City Manager to proceed in the
development of a design build contract for the proposed Murray Park
Community Pool.
WHEREAS, the City has secured a CDBG grant in the amount of $1,207,374.00 for construction
and a SNP grant of $220,050.00 for construction but only 17% may be used for design. The SNP grant
expiration date has been extended to September 30, 2012 and it may be possible to extend it further if
progress is shown toward the construction of the community pool. The CDBG grant is due to expire on
December 31, 2012 but it also may be extended if substantial progress is shown towards the completion
of the pool; and,
WHEREAS, the City received proposals in response to an RFP from design build companies for
the design and construction of the pool; and,
WHEREAS, the City Manager was authorized to negotiate a design build contract with Di
Pompeo Construction for the proposed Murray Park Community Pool; and,
WHEREAS, Di Pompeo Construction Corporation has previously submitted a proposal and
subsequent design concepts, and a final design concept, based on input from the Mayor, Commissioners
and staff that meets the basic requirements of the City for a community pool and is projected not to
exceed the total of the collective amounts of the relevant grant funding for design and construction;
and,
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF
SOUTH MIAMI, FLORIDA:
Section 1. The City Manager is hereby authorized to proceed in the development of a design
build contract with Di Pompeo Construction Corporation that includes the final design concept
submitted by Di Pompeo Construction Corporation for the construction of the proposed Murray Park
Community Pool based on the attached proposal.
Section 2. Severability: If any section, clause, sentence, or phrase of this resolution is for any
reason held invalid or unconstitutional by a court of competent jurisdiction, this holding shall not affect
the validity of the remaining portions of this resolution.
Section 3. Effective Date: This resolution shall take effect immediately upon enactment.

Subject: A Resolution approving the current design concept
submitted by Di Pompeo Construction Corporation and
authorizing the City Manager to proceed in the
development of a design build contract for the proposed
Murray Park Community Pool.
Background: At the April 17, 2012 Commission meeting, the Commission authorized the City
Manager to negotiate a design build contract with Di Pompeo Construction
Corporation for the proposed Murray Park Community Pool. A Special Meeting
was held on April 25, 2012 to provide design direction to the contractor. As a
result of the Special Meeting, and subsequent meetings with staff, the final design
concept is enclosed for your review and approval. The design concept is
summarized below which includes, Di Pompeo's design costs ($150,000):
• Contract Total: $1,404,000
o Design concept includes:
01 15' x 40' Learn to Swim Pool
a 21' x 75' Lap Pool
• 1800 sf Spalsh Pad w /Water Tot Lot Items
■ Security Camera System
■ Solar Water Heater for BR & Showers
Other options were discussed however, due to the constraints of the grant
funding and other operational factors; some of those options were not included
into the final design concept; such as: geothermal heat well, saline chlorination
system, splash sensor, etc. Please refer to the "Exclusions" section of the
attachment from Di Pompeo Construction. The saline chlorination system for
example was not recommended by Di Pompeo. The system has high upfront cost
and the pool would still need a tradition chlorine system. Commercial pools
require both systems to be in compliance with sanitary and disinfecting standards.
Although the saline chlorination reduces the amount and operational costs of
chlorine, we are limited by the amount of the grant funding and the number
options that can be included into the final design. The available funding is listed
below:

The available grant funding totals $1,546,411, less $162,409 for design; leaving a
balance for pool construction of $1,384,002. Staff recommends setting aside a
10% contingency for any unplanned or unexpected issues that usually arise with a
construction project. The amount of the contingency plus any remaining balance
of the pool construction and design grant funds is $142,411, leaving a balance of
$1,254,000 for pool construction. Not included into Di Pompeo's construction
costs are outside City permits and fees, which are covered by the SNP
construction portion of the grant:

Upon approval of the final design, Di Pompeo will complete detailed drawings as
part of the design build contract. The contract will also include a timeline
identifying milestones such as, permitting and certifications, to include;
Department of Health and Miami -Dade County and general construction permits,
up to and including the TCO.

Corporation during the design concept phase of the Murray Park Community
Pool project concerning operational cost efficiencies.
WHEREAS, the City has secured a CDBG grant in the amount of $1,207,374.00 for construction
and a SNP grant of $220,050.00 for construction but of which 17% may be used for design. The SNP
grant expired as of March 31, 2012 but the City has submitted a request for an extension to September
30, 2012 and possibly further if progress is shown toward the construction of the community pool. The
CDBG grant is due to expire on December 31, 2012 but it also may be extended if substantial progress is
shown towards the completion of the pool; and,
WHEREAS, the Commission previously authorized the City Manager to negotiate a design build
contract with Di Pompeo Construction for the design and construction of the pool; and,
WHEREAS, Di Pompeo Construction Corporation has submitted a proposal to the City that
includes a design concept that meets the basic requirements of the City for a community pool; and,
WHEREAS, the City desires a pool design that incorporates concepts that will generate
operational cost efficiencies for the City; and,
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF
SOUTH MIAMI, FLORIDA:
Section 1. Di Pompeo Construction is hereby directed and authorized to design the proposed
Murray Park Community Pool in accordance with the following operational cost efficiency concepts:
A learn -to -swim fool._ a lap pool, and a 2000 sq. ft. splash area. The commission does not want a
kiddie's pool nor does it want a splash pool.
Section 2. Severability: If any section, clause, sentence, or phrase of this resolution is for any
reason held invalid or unconstitutional by a court of competent jurisdiction, this holding shall not affect
the validity of the remaining portions of this resolution.
Section 3. Effective Date: This resolution shall take effect immediately upon approval by vote of
the City Commission.
