Res No 107-12-13664RESOLUTION NO. 107-12-13664 A Resolution authorizing the City Manager to execute an Intergovernmental Agreement to perform Traffic Engineering Functions (AGREEMENT) between the City of South Miami (CITY) and Miami -Dade County (COUNTY), to assume the installation and maintenance responsibilities of five speed tables located within the Pinecrest Villas Neighborhood. WHEREAS, traffic improvements to attain pedestrian friendly environment are vital to the lives of all residents of the City of South Miami; and WHEREAS, the City of South Miami Commission wishes to continue implementing the City's Neighborhood Traffic Calming Study for the City of South Miami's Pinecrest Villas Neighborhood; and WHEREAS, the City has been presented with an Intergovernmental Agency Agreement with Miami -Dade County to perform Traffic Engineering Functions for the City of South Miami's Pinecrest Villas Neighborhood and WHEREAS, the agreement identifies and lists the location of the speed table installations specifically approved by Miami -Dade County for the City to install and maintain. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA: Section 1: The City Commission of the City of South Miami authorizes the City Manager to execute an Intergovernmental Agency Agreement with Miami -Dade County to perform Traffic Engineering Functions for the City of South Miami Pinecrest Villas Neighborhood. Five speed table installations are located at: SW 79 Street between SW 59 Avenue and SW 62 Avenue (two speed tables), SW 58 Avenue between SW 78 Street and SW 80 Street (One speed table), SW 58 Avenue between SW 74 Terrace and SW 76 Street (One speed table), along SW 76 Street between SW 58 Avenue and SW 59 Avenue (One speed table). Resolution: A Resolution authorizing the City Manager to execute an Intergovernmental Agreement to perform Traffic Engineering Functions between the City of South Miami and Miami - Dade County, to assume the installation and maintenance responsibilities of five speed tables located within the Pinecrest Villas Neighborhood. Background: The City and Public Works Department have received numerous complaints from the residents of vehicular speeding, and requests for traffic calming measures to reduce speeding and address a concern for safety. A traffic calming study was performed by City consultants on behalf of the Public Works & Engineering Department to address concerns of the residents in the Pinecrest Villas Neighborhood. Multiple locations were identified and recommended for installation of speed tables. Three speed tables were previously approved and constructed. Five additional speed tables received approval from Miami Dade County Public Works Department on April 4, 2012. The County requires the City to enter an Agreement authorizing the City to assume installation and maintenance responsibilities of these traffic calming devices. Justification: By allowing the execution of the above - referenced agreement, the City will have fulfilled the requirement of the Miami- Dade County Public Works Department Traffic Engineering Division to move forward in implementing the City's Traffic Calming Study Expense: Not Applicable Account: There are no fees or cost associated with this Intergovernmental Agreement. Attachments: Proposed Resolution Intergovernmental Agreement Engineering Drawings INTERGOVERMENTAL AGENCY AGREEMENT TO PERFORM TRAFFIC ENGINEERING FUNCTIONS THIS INTERGOVERNMENTAL AGENCY AGREEMENT TO PERF RM TRAFFIC ENGINEERING FUNCTIONS (AGREEMENT), made and entered into this day of 201 T, by and between the City of South Miami, FLORIDA, a municipal corporation of the STATE OF FLORIDA, hereinafter referred to as the CITY and MIAMI -DADS COUNTY (COUNTY), a political subdivision of the STATE OF FLORIDA, MIAMI -DADE County. WITNESSETH WHEREAS, pursuant to Section 2 -96.1 of the Miami -Dade County Code, aii traffic control and traffic engineering services in Miami -Dade County are under the exclusive jurisdiction of the COUNTY; and WHEREAS, the CITY desires to assume the installation and maintenance responsibilities of certain traffic engineering functions pertaining to its local municipal streets only; and WHEREAS, the COUNTY has determined that the CITY is both equipped and able to perform the traffic engineering functions as herein specified on its local streets; and WHEREAS the CITY has, by proper resolution attached hereto and by reference made a part hereof, authorized its officer(s) to enter into this AGREEMENT. NOW THEREFORE, the CITY and the COUNTY agree as follows: 1. The recitals set forth above are incorporated herein by reference. 2. The CITY will only install and maintain the following designated types of traffic control devices and only on those local municipal streets operated and maintained by the CITY within its boundaries: (List devices) Speed Tables: • Two speed tables along SW 79 Street between SW 59 Avenue and SW 62 Avenue • One speed table along SW 58 Avenue between SW 78 Street and SW 80 Street • One speed table along SW 58 Avenue between SW 74 Terrace and SW 76 Street • One speed table along SW 76 Street between SW 58 Avenue and SW 59 Avenue I Traffic calming devices may be installed on local municipal streets only after an appropriate traffic engineering study has been performed and sealed and signed plans have been submitted to the Public Works Department of the COUNTY for its review and approval. 3. The CITY shall attach a decal to the back of the sign panels indicating ownership and date of installation. 4. The CITY assumes sole and complete responsibility for the maintenance of all such signs that are installed by the CITY within its boundaries. 5. The CITY assumes sole and complete liability for any accidents and /or injuries which may or are alleged to occur or arise out of the installation, operation or maintenance of said traffic control devices, and hereby indemnifies and saves harmless the COUNTY from any and all claims of negligence as a result of the installation, operation or maintenance of said signs. 6. All traffic control signs installed by the CITY in accordance with this AGREEMENT shall conform to the applicable requirements established by the following publications: • Florida Department of Transportation's Standard Specifications for Road and Bridge Construction. • Manual on Uniform Traffic Control Devices for Streets and Highways, U.S. Department of Transportation Federal Highway Administration (ANSI D6.le- 1989), including latest revisions. • Standard Highway Signs, U.S. Department of Transportation, Federal Highway Administration. • Miami -Dade County Public Works Manual (available from the Public Works Department, Reproduction Services, 111 NW 1 Street, Suite 1604, Miami, FL 33128) 7. For installation of traffic control devices, the CITY shall hire a COUNTY licensed contractor or perform the work in -house by the CITY Public Works crew. 8. Should the CITY install street name signs at the same site where a stop -top street name exists, then the CITY shall utilize the other corners of the intersection. Subsequently, the CITY shall remove the COUNTY'S stop -top street name signs by an approved sign contractor. All signs and hardware removed shall be dismantled and returned to the Traffic Signals and Signs Division of the COUNTY'S Public Works Department. 9. The CITY shall be responsible for keeping records of any and all installations and repairs, and furnishing pertinent documents as and when said records may be requested. 2 10. Failure to carry out any of the duties and responsibilities assumed herein by the CITY may result in termination of this AGREEMENT, at the sole discretion of the COUNTY. Resolution: A Resolution authorizing the City Manager to execute an Intergovernmental Agreement to perform Traffic Engineering Functions between the City of South Miami and Miami -Dade County, to assume the installation and maintenance responsibilities of five speed tables located within the Pinecrest Villas Neighborhood. Background: Between January to February of 2012, survey ballots were hand delivered to affected resident for the installation of these devices. Miami -Dade County requires 213 concurrence from residents before approving the Agreement. Ballots returned to the City showed overwhelming support for these devices specific to the following areas: • 86% Concurrence - Two speed tables along SW 79 Street between SW 59 Avenue and SW 62 Avenue; • 100% Concurrence - One speed table along SW 58 Avenue between SW 78 Street and SW 80 Street; • 95% Concurrence - One speed table along SW 58 Avenue between SW 74 Terrace and SW 76 Street; • 100% Concurrence - One speed table along SW 76 Street between SW 58 Avenue and SW 59 Avenue, On March 21, 2012, the City's Public Works Department submitted engineering drawings along with ballot responses for County review. The City received approval on April 19, 2012 to install and maintain these traffic calming devices in the area. Prior to construction, the City must first enter an Intergovernmental Agreement with Miami -Dade County accepting the terms and conditions associated with these devices. jY �,us i+r r rOMMUP IV Date: May 7, 2012 Subject: Traffic Calming Devices Miami Dade County's approval to install a speed table at SW 79th Street between SW 62nd Avenue and SW 59th Avenue; SW 76th Street between SW 59th Avenue and SW 58th Avenue; SW 58th Avenue between SW 781h Street and SW 80th Street Dear resident: Please be informed that Miami -Dade County's Public Works Traffic Engineering Division approved the proposed installation of speed tables at the above - referenced subject locations. A resolution is prepared for the Commission authorizing the City Manager to execute an Intergovernmental Agreement with Miami -Dade County to construct and maintain the speed table for the area. The construction of the traffic calming devices is anticipated to begin in July of 2012. With your petition and resident survey ballot concurrences, the City was successful in conveying the need for traffic calming devices in an area that has documentation of speeding vehicles. For this reason, Miami -Dade County approved the proposed installation of the traffic calming devices at the following locations: • SW 58th Avenue — one speed table located approximately 138 feet south of SW 78th Street; • SW 76th Street — one speed table located approximately 360 feet east of SW 59th Avenue; • SW 79th Street — one speed table located approximately 370 feet east of SW 62nd Avenue; • SW 79th Street — one speed table located approximately 250 feet west of SW 59th Avenue. A resolution is prepared for the Commission authorizing the City Manager to execute an Intergovernmental Agreement with Miami -Dade County to construct and maintain the speed table for the area. The construction of the traffic calming device is anticipated to begin in July of 2012.
