RESOLUTION NO. 102-13-13920
A Resolution relating to a request pursuant to Section 20- 3.4(B)(4)(b) of the
Land Development Code for Special Use Approval to locate a walk up
restaurant at 5831 Sunset Drive, within the Specially Retail "SR ",
Hometown District Overlay "HD -OV" zoning district.
WHEREAS, pursuant to Section 20- 3.4(B)(4)(b) of the Land Development Code (LDC),
the applicant, Temple South Miami, LLC submitted to the Planning Board Application No. PB-
13 -008 requesting a Special Use Approval to operate a walk up restaurant to be located at 5831
Sunset Drive, within the Specialty Retail "SR ", Hometown District Overlay "HD -OV" zoning
district; and
WHEREAS, a walk up is permitted as a special use in within the Specialty Retail "SR ",
Hometown District Overlay "HD -OV" zoning district and is subject to meeting general
conditions specified in LDC Section 20 -5.8 and subject to meeting special use requirements set
forth in LDC Section 20- 3.4(B)(4)(b); and
WHEREAS, the approval of a special use requires a recommendation from the Planning
Board and the approval of the City Commission after a public hearing; and
WHEREAS, at the April 22, 2013 Special Meeting, the Planning Board following a
public hearing heard application PB -13 -008 and recommended unanimous approval of the
special use request; and
WHEREAS, the City Commission desires to accept the recommendation of the Planning
Board,
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA THAT:
Section 1: Special Use Application (PB -13 -008) submitted by applicant Temple South
Miami, LLC, for approval to operate a walk up restaurant located at 5831 Sunset Drive, within
the Specialty Retail "SR ", Hometown District Overlay "HD -OV zoning district is hereby
approved subject to the following terms and conditions as well as all applicable City
ordinances, codes, rules and regulations:
(1) Adhere to the Special Conditions applicable in Section 20-
3.4(B)(4)(b)General Restaurant and Section 20 -5.8 Special Use Approval of the Land
Development Code, listed.
(2) The parking agreement between the applicant and the City for the necessary
parking spaces must be completed prior to the issuance of the Business Tax Receipt for
the walk up restaurant.

(3) All signage for the new establishment is subject to review and approval by
the Environmental Review and Preservation Board (ERPB).
(4) Any and all exterior renovations or modifications are subject to review
and approval by the ERPB
(5) A separate application for outdoor dining would be required as per Section
20- 3.3(E)(2) Outdoor Seating / Dining for all commercial Properties, of the Land
Development Code.
(6) If the subject walk up restaurant is determined by the Planning and Zoning
Director in the future, to be adversely affecting the health or safety of persons residing or
working in the vicinity of the proposed use, or to be detrimental to the public welfare or
property or improvements in the neighborhood, or not be in compliance with other
applicable Code provisions, the special use approval may be modified or revoked by the
City Commission upon notification and a public hearing.
Section 2. Severability. If any section clause, sentence, or phrase of this resolution is for
any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall
not affect the validity of the remaining portions of this resolution.
Section 3. Effective Date. This resolution shall become effective immediately upon
adoption by vote of the City Commission.

BACKGROUND
Pursuant to Section 20- 3.4(B)(4)(b) of the Land Development Code (LDC) the applicant, Temple
South Miami, LLC, is requesting Special Use Approval to operate a walk up restaurant at the
above referenced location. The location of the restaurant will be in an existing street level
storefront of a three- story, multi tenant retail /commercial building, and occupy the westernmost
storefront of the building (Fig. 1). This proposed use is located in the "SR" Specialty Retail,
"HD -OV" Hometown District Overlay zoning district which allows restaurants if approved
through the special use process. The LDC provides that special uses must be approved by the
City Commission after a public hearing and receipt of a recommendation from the Planning
Board. Pursuant to the requirements for special use application review, the applicant provided
notification via certified mail to the surrounding property owners of their intent to file said
application; documentation is on file with the Planning & Zoning Department,

STAFF ANALYSIS
All of the uses currently on the ground floor of this building are retail; the proposed restaurant
will replace a former retail establishment. The restaurant called "Temple ", is intended to be quick
service establishment serving organic food and drinks [Figure 2]. The applicant's letter of intent
is attached for your review. It is proposed that Temple will have sixteen (16) seats and occupy
approximately 900 square feet of the building, in the space that was previously occupied by the
jewelry store.
Pursuant to the City's Land Development Code a walk -up restaurant shall mean an establishment
where the principal business is the sale of food and beverage to the customer in a ready -to-
consume state and where the design or principal method of operation is that of a storefront
restaurant offering quick food service to pedestrian where orders are taken at a counter, where
food is generally served in disposable wrapping or containers, and where food and beverages
may be carried out or consumed at tables in a patio area on private property. This use excludes
any service to a customer in a motor vehicle, but may include delivery service with City
Commission approval.
The general character of the surrounding area is commercial- retail, restaurant and office uses,
which are consistent with the City's central business district. The proposed use is consistent
with the zoning use district and surrounding uses. Based on the square footage this restaurant
will require approximately nine (9) parking spaces (1 space per 100 sq. ft.). Although there is
metered on- street parking Sunset Drive and throughout the general area, the applicant is still
required to comply with the City's parking requirements. If the applicant is unable to provide
on -site parking, then they must either apply for and receive a special exception pursuant to
Section 20 -7.51 of the City's Land Development Code, waiving the number of required
spaces, or pay into the Hometown District Improvement Trust Fund [Section 20- 7.6(C)(2)(b)
and (c)]. The applicant may also enter into a parking agreement with a provider that has
surplus parking spaces, such as the municipal garage. The proposed restaurant has been
allocated some parking at the rear of the building and has a letter of intent to enter into a
parking agreement with the municipal garage for the remainder. If approved, parking
agreement needs to be in place prior to the issuance of any permits.

SPECIAL CONDITIONS APPLICABLE:

The overall purpose of going through the special use process is to determine the compatibility of
the proposed use with the surrounding neighborhood. A special use must comply with the
conditions set forth in Section 20- 5.8(13) in that the use:
a) Will not adversely affect the health or safety of persons residing or working in the
vicinity of the proposed use;
b) Will not be detrimental to the public welfare or property or improvements in the
neighborhood; and,
c) Complies with all other applicable Code provisions.
Any exterior modifications to the building including the installation of signage, will require an
application to the ERPB for review and approval. Any outdoor seating shall require an
application to be filed with the Planning Department, subject to the requirements set forth in
Section 20- 3.3(E). It is important to note that the use must also comply with Department of
Health, Hotels and Restaurants and /or Department of Agriculture requirements, and must be
licensed by one or more of these agencies prior to obtaining a City license.
RECOMMENDATION
Staff recommends approval of this special use request for a walk -up restaurant (Temple), to be
located at 5831 Sunset Drive.

Sebastein Petro stated that Temple is a whole food plant based concept. He stated that they plan
to serve breakfast, lunch and dinner with the hours of seven (7) am to nine (9) pm. He then stated
that the concept is based on the ayurveda lifestyle, where we sell food based on the diet of each
specific person.

Mr. Brimo clarified that the outdoor seating is based on the percentage of the indoor seating; you
can have up to eighty (80) percent of the seating outside. He also stated that this is an
administrative review by the City Manager if it meets the criteria for outdoor seating.
Ms. Fischer asked the applicant if the food will be prepared on site or will it be brought in from
somewhere else. The applicant replied that it will be prepared on site. Ms. Fischer then asked the
applicant if recyclable or environmentally sustainable plates and containers will be used for the
food and drinks. The applicant responded that when patrons dine in the plates will be bamboo
and the carryout containers will be plastic, we will be as sustainable as we can. Ms. Fischer also
asked if they will have any kind of receptacle where people can dispose of recyclables rather
than trash. The applicant responded yes that is correct. Ms. Fischer stated that this restaurant is in
accordance with the vision of the formerly active Green Task Force and the South Miami
Farmer's Market of Garden Committees. She then stated that in two ways this restaurant will
benefit the patron's of the restaurant with food and beverages being organically sourced and the
intention of buying organic produce from local farmers. She also stated that former members
from the committees that were mentioned will be in support of business and be happy about your
vision.

Dr. Philips stated her concern of dumpster locations and how the garbage would be taken care of.
Mr. Brimo stated that all commercial properties are required to have commercial pick -up;
typically these dumpsters or trash receptacles are located in the rear of the businesses and they
will have to comply with the requirements for food service as opposed to the non food service
types of trash that a business will have. Dr. Whitman asked if this will be reviewed when they
get their Occupational License. Mr. Brimo responded yes that is correct.

to City of Miami statutes, of their intent to apply for a Special Use Permit for a
new restaurant at the above referenced address.
Based on the booming demand for healthy and organic food crossed with a
global obsession for well being, we decided to launch a unique quick service food
concept: Temple. Temple will offer a refreshingly original food and drink concept
that cares about the values of the small stuff in what we eat and drink; enabling
us to cope with the big stuff thrown at us in life today. Temple will offer a plant
based personal diet with smoothies, fruit juices, salads, soups, steam veggies, all
with the purpose to help people to refuel and respienish. We will work with local
farmers, have an on -line nutritional consultation available and will be
environmentally sensitive.
The Temple concept will add a fresh alternative eating experience and will make
an excellent contribution to the Sunset Drive food district. It is our great hope that

The property is being leased on a NNN basis. Tenant shall pay its pro -rata share per
square foot of these expenses. Current Taxes, Insurance and Maintenance are
approximately $10.00 per square foot.

Tenant shall carry insurance, standard for this industry, in an amount required by the
Landlord's carrier. Landlord shall be named as Additional Insured for the full Term of

TENANT IMPROVEMENTS
Tenant may install such tenant improvements, fixtures and finishes in the Premises as
Tenant deems necessary or desirable. Tenant may remove its improvements and fixtures
not permanently affixed to the property when it vacates the Premises. All construction
shall be permitted and undertaken by licensed contractors. Landlord shall be named as
Additional Insured by all contractors.
OUTDOOR SEATING
Outdoor seating will be permitted as per code in front of premises and also in arcade area.
PARKING
Landlord to provide one (1) parking space in rear of premises to Tenant.
SECURITY DEPOSIT
First (l') month of prepaid rent and one (1) month security deposit shall be paid to
Landlord upon execution of the lease.

Tenant will provide a two (2) year guaranty that will burn off in month twenty -four (24)
of the initial term of the lease.
SIGNAGE
Tenant shall have the right to install signage on the property and /or the building in
accordance with signage codes set forth by the City and in accordance with other signage
currently on building. All such installations shall be permitted by the municipality and
the cost of such permits and signs shall be the responsibility of the Tenant.
Tenant shall have the right to assign or sublet the entire premises with the prior written
consent of the Landlord, which will not be reasonably withheld or delayed.
