ORDINANCE OF CITY OF SOUTH MIAMI, FLORIDA,
GRANTING VARIANCE TO ZONING REQUIREMENTS TO
- - THE CITY PERTAINING TO SIDE SETBACK REQUIRE-
MENTS SO AS TO PERMIT CONSTRUCTION OF A NON-
CONFORMING ADDITION TO AN EXISTING RESIDENCE
ON LOT 17, REVISED PLAT OF POINCIANA PARK;
PB 41/41; A /K/A 7220 SW 61 COURT.
WHEREAS, W. L. SAULS duly made application for a
variance as to side setback requirements so as to permit
construction of an addition to an existing residence on the
lands hereinafter described, and
WHEREAS, 'the Planning Board of the City duly held a
Public hearing on said application on "June 6, 1967, and there-
after recommends that the application be approved, and
WHEREAS, the City Council, after the holding of a' duly
adverfised'p'ublie-hea'rii gg, 'the hearing of I- terest'ed parties
and considering the recomm�t "ion' "of said Board, find that
the existing zoning regulations as to side setback requirements
constitute an undue hardship as applied to the particular property;

IT ORDAINED"'BY THE MAYOR AND CITY COUNCIL OF CITY OF
SOUTH MIAMI, FLORIDA:
1. A variance is hereby:grarited as to the side setback `
requirement" S promulgated by the zoning o "r'dinaiices of the City
and in particular Chapter 20 of the -Code of Ordinances 'so as
to permit the construction of an addition to an existing''-
residence with a side (North) setback of '4.2 'feet from the
property line. Said lot being legally described as, to -wit:
Lot 17'REVISED1PLAT OF p' I PARK, according
to the " Plat thereof as recorded in Plat Book 41
at Page 41 of the Public Records of Dade County,
Florida, a /k /a 7220 SW 61 Court.
2. The variance hereunder Shall be operative only'as to
the required side setback on the North property line.
3. In the "event an application for a buildin°' ermit is
not filed in conformity with "the variance granted`hePeunder
within 180 days from Oie'date of the passage of this ordinance,
the variance granted shall become null, void and of no force
and effect without further Council action, and the property
shall revert to its prior zoning status.
